Kosovo security organs were not mentioned at Tuesday's conference in Albania's Police, when news of the arrest of Asamisti Besnik Mujejci and four other people who were found 11 thousand and 300 suspected pills as heavy drugs, ecstasy.
KOHA has contacted the Kosovo Police and Albania, but has not received answers if these institutions have co-operated in the investigation process for the case.
Mujejci is in holding in Albania. The District Court in Tirana has not answered questions concerning the appointment or holding of the hearing for the security measure for the defendants. Albania's Constitution owes the courts the move to assign indictees within 48 hours after the arrest, but leaves them additional time of another 48 hours.
The “Person to whom freedom has been removed, according to Article 27, paragraph 2, subparagraph “c”, should be sent within 48 hours before the judge, who puts his detention or release no later than 48 hours from the point of checking the document, says Article 28 of Albania's Constitution.
Through the Chamber of Lawyers in Tirana, KOHA has made efforts to establish contact with the lawyers of the five defendants, but its officials have offered no answers with the reasoning that they are on leave.
Asembilist Mujeci has been excluded from Vetevendosje membership and forums several hours after being arrested infrcion, along with another Kosovo citizen and four other citizens of Albania.
The Law on Local Self-Government does not predict that a member of the Municipal Assembly loses its mandate in case of arrest or detention.
Eugen Cakoli, a researcher in KDI, points to the situation when Mujejci may remain without the seat of Pristina's Asamblist.
“If Besnik Mujec continues the detention measure in the Albanian state or even if such a move will be implemented in Kosovo and during the length of this measure, Pristina's Municipal Framework will hold three meetings where his refusal to accept it is declared then initiated procedures for replacing it by the head of the Communist Assembly. The last possibility is that if Besnik Mujeci is sentenced to a firm-shaped decision on the criminal acts he is charged with, in prison for over six months, he will lose his mandate”, Cakoli said.
According to Cakolli, after the arrest Mujejci must resign because of the failure of the mandate.
During the arrest operation, Mujeci and the other four were found over 11,000 ecstasy pills worth about 400,000 euros worth of market, which Albania's police suspect have been trafficked from Kosovo and were destined for Albania's frequent coastline.
