Defence Ministry Rewards tender for cleaning Chinese stock company

The Army of the Republic of Kosovo on Monday has decided that the tender for cleaning over its covers is a company I trust in a company where the shareholder is also a Chinese citizen. The defence ministry has made that decision even after it has been informed of that fact.

This announcement has gone through electronic procurement firm “Eco Clearing Corporation sh.pk.”, the property of Arber Gashi, but where 20 per cent of the shares are also owned by Chinese national Wendy Jung.

Insander had sent questions to the Ministry of Defence since the bids for this tender were opened, announcing also the fact that the stake in this company has a citizen from the People's Republic of China, but this ministry has so far given no answer.

On March 3rd of this year, the Defence Ministry's Procurement Office has issued an official document that announces the company “Sh.p.k. that they were awarded contracts from the tender “The laundry and clothing services for KSF's needs”, tender I launched on 22 February of this year.

In this company that the Defence Ministry contracted, and on Monday it issued its new decision, 20 % shares are held by Chinese national Wendy Yang, born in June 1990. According to data in the Business Register, it appears since this company was founded, in August 2019, has invested 800,000 euros, while another 320 thousand euros has been invested in Kosovo citizen Arber Gashi, who holds 80% shares in the firm.

Asked about this contract has been the Ministry of Defence and the fact that a business partner who is awarded the contract is a Chinese citizen, but the same have so far refused to comment.

They have refused to comment on a complaint against this decision to repay the company “Sh.p.k. and the complainer mentions a number of violations of the procurement law.

Contacted was also the company “Sh.p.k. And the big partner in the firm, Arben Gashi, told the newspaper that Wendyun Yang is a citizen of China, but they met with her during studies in America.

“Wenyuun Yang is investors. I met him in America and decided to send a business to Kosovo. I don't see any problems here”, Gashi said.

Although his business partner is Chinese citizens, he had indicated that when he offered for the KSF's laundry tender, this institution had not requested any documents concerning this partner in business.

It has regular residence permits in Kosovo. We have not been asked for any other document, except what was asked for in the contract announcement”, Gashi stated.

According to Gashi, the company is registered in Kosovo, but is also American companies. But for this statement he did not send any evidence that his company and Chinese national, Yenyun Yang, is also American companies.

He has told him this is not the first time they won this tender in the KSF.

 

 

This is the second time we've won this tender, but the first time a company has complained, which has been tendering for years. We've been with cards all right, and cheaper. We have left the law to decide, but in the meantime we have also notified the American Embassy in Pristina of this case”, Gashi said.

Asked what the American Embassy's response was, he said they did not receive answers, since he had not asked for anything from them, except to inform them.

The OSP had requested re-evaluation, raised suspicions about some bills

Regarding this tender, which was rewarded “ECO CLEAN CORPATELON” Sh.p.k., owned by Kosovar Arber Gashi and Chinese national Yenyu Yang, in OSHP was filed in complaints by the next company in the race, “A.L. S.p.k. shower”.

The company claimed that the Defence Ministry when it decided to reward the firm “The ECO CLEAN CORPORATION” Sh.p.k., violated 4 articles in the Procure Law.

And they claim that this firm has not met the tender criteria, but was rewarded. “A.L. S.p.k. shower”. Claim “ECO CLEAN... was rewarded, even though the document failed to fill even one of the basic criteria that is the circulated value of services that should not be less than 100,000 euros in the last three years.

“ECO CLEAN...”, according to the complainer has filed tender application files and other services he has performed for clients in the private sector, which are not only about cleaning, as requested by the KSF, but other services such as the supply of drinks, but were accepted as references from the Ministry of Defence.

There have been remarks, and even suspicions that some of the tools, including a car, that have emerged as the company “ECO CLEAN...”, are they still owned by the company in question or not, and that this should disqualify the company from the race.

“Consistent that AK (Second Ministry) during the re-evaluation of the bids should confirm the article 59.2 and 72 of the LPP to request additional clarifications from the OE recommended for the contract by asking all the bills that were issued on behalf of OE “Lakeside AG” sh.p.k. and the same bills to verify in Kosovo Tax Administration in order to prove whether these bills were registered as sale in ATK, as well as purchasing receipts from “S.p.k. to verify whether they are registered as purchases through which it is supplied with services from the recommended OE. If the bills are registered and declared in ATK, the payment issue is related to ATK's legal obligations on tax issues. For contracting authority it is important to make sure that these bills are registered and the service occurred according to the tender's request”, it is said in the OSEP's decision.
