If Dr. Mitrev were using hemofiltration in order to deceive patients, he would have deceived all 1738 patients who deposited revenue for hemofiltration and not just 16% of them as the prosecution claims.

The prosecutor misinterpreted the content of authorisation for the use of filters by citing sections that refer to filters distributors and sellers, not doctors and clinics, which he later attributes to Dr. Jean Mitrev, who's not a filter dealer for hemofiling. The defence presented and clarified by numbers that the success of treatment at the clinic, Jean Mitrev, completely rejects the charge. The mortality rate at the Jean Mitrev Clinic from July 2022 is 25.4%, while in the public health institution the mortality rate is 51.3%.

“In the Jean Mitrev Clinic, patients with COVID-19 are treated in a modern SISTEM for intensive care, the only one in the region accredited by JCI (JCII) (Jint Commission International), which means that it meets the highest security standards in treating patients and higher standards in preventing intraspital infections, and consists of 51 doctors, 86 personnel belonging to inter-minal staff and other workers, and are not personally treated by Dr. Jean Mitrev” stressed protection in the opening word.

There is no reliable evidence to convince the court that Dr. Jean Mitrev has used the hemofiling in order to benefit and follow illegally, and that he has accomplished that goal to only 282 patients out of a total of 1738 treated for COVID-19 in the clinic, or 16% of the total number treated. If the hemofiling was used by Dr. Jean Mitrev in order to deceive patients to profit illegally, he would have deceived all 1738 patients who had already deposited revenue for hemofiling and would not have deceived only 16% of them as claimed by the prosecution.

A total of 1738 patients have been treated at the Jean Mitrev clinic for Coved-19, and all according to the filter manufacturer's recommendations and according to recommended indicators.

The defence recalled responsible social role and beneficial public role played by Dr. Mitrev and clinical hospital Jean Mitrev in conditions where public health during the pandemic with Cavid-19 had fallen to its knees and was in collapse, and when, in extraordinary situations, the government was acting with legal force, speech, and the fact that on June 16, 2020, the clinic Jean Mitrev was called by the state to treat patients with Codov-19. After that call, Jean Mitrev's medical team, with over 300 employees, did not commit a single bribe, but fought day and night to save lives from Covid-19 at the request of the state.

The defence also introduced information that the state has made the clinic Jean Mitrev available at the height of the pandemic its hemofiltration device so that the clinic can perform more hemofiltrations and now accuses him of cheating by performing hemofiltration.

“With this unfounded indictment and with this process, Macedonia becomes the only country in the world to have initiated a legal process against a doctor and a clinic that has dealt with in the emergency situation of Covid-19, while laws for immunity of healthcare providers in the US have been passed concerning Covis-19, the defence stressed in the opening word.

“Cardiosurgeon Jean Mitrev personally performed 25162 cardiosurgic and vascular operations, which in Germany is the standard of 5 lives of cardiosurgeons. The only thought that exists in his mind is how to save lives rather than cheat patients”, Dr. Mitrevi's defense stressed.
