The 39-year-old, has been on hold since January for an accusation that he violated a woman at a Barcelona nightclub in December, Periscopi forwards.
His lawyer had demanded that he be released if he handed over his passport and wore an electronic label.
The court rejected the request, saying that it was considered a serious danger.
“There is a high risk of escaping because... the severe punishment he faces in his current case and his economic [sources] may enable him to leave Spain at any time, the Barcelona court said.
Mexican club Pumas UNAM suspended the Alves contract in January when he was held in custody.
Alves played 408 matches for Barcelona in two periods, winning six La League titles and three Champions Leagues between 2008 and 2016.
The defender has also played for Paris St-Germain and Juventus among other clubs and has made 126 presentations for Brazil, including twice at the 2022 World Cup.
