In this session, the parties in the procedure have delivered the final word in written form, while during its extradition, prosecutor Sebahate Sinan proposed that the court indictees plead guilty to criminal acts both in the indictment and pronounce a sanctions with which the purpose of the sentence would be reached.
The party's representative, Lumeni Salihu, declared he supports the prosecutor's word and that there is nothing to add.
The defendant Sabedin Mustafa's replacement, lawyer Ylka Dashi and defender Ramadan Ukzmajli, lawyer Liridon Jetishi, delivered the final word in writing.
And the defender of the accused Bequ Uka, lawyer Vehbi Kashtaneva, said he was not proven to have committed a criminal offense by his defender, so the judge proposed that he receive a free trial.
The defendant's defender, Hasim Balija, lawyer Elmaz Zenun, also said that no evidence has proved his defender guilty, so he sought to be acquitted. While for the illegal weapons offense Balija has pleaded guilty to, Zenun lawyer proposed to the court to decide on a mild sentence.
Defenders of the accused: Bahri Baliu, Ibrahim Halilaj, Ahmet Bajraktari, Avdi Agashi, Naim Avdyli, Ali Kosumi, Rasim Avdyli and Isuf Qerkuni, lawyers: Vladim Alijaj, Rafiz Shehu, Visar Musa, Bekim Sylejmani, Faton Neziraj, Burim Krasniqi, Kemal Ademi and Elvira Heta-Vata, delivered the final word in written form. Their defenders, however, claimed they backed the word handed down by lawyers.
In this case, according to the indictment, Sabedin Mustafa, Beqa, Hasim Balija, Ramadan Ukzmajli, Bahri Baliu, Ibrahim Halilaj, Ahmet Bajraktari and Avdi Agashi are charged with the criminal work of “Kek misuse of official position or authority”.
For accused Sabedin Mustafa and Ahmet Bairaktari, for criminal work “use official position or authority”, from Article 414, paragraph 3, subparagraph 3.2 concerning paragraph 1 and Article 31 of KPRC, (positive VI of the July 5th 2021 indictment), the prosecutor on December 11th 2023 has withdrawn from prosecution.
The accused Sabedin Mustafa, Hasim Balija, Bahri Baliu, Avdi Agushi and Ahmet Bajraktari according to the indictment, are also charged with illegal weapons prosecution. For what, at the initial session held on August 25, 2021, only Ahmet Bajraktari was declared. While on December 11, 2023, the prosecutor has withdrawn from prosecution to indictee Avdi Agoshi.
For the criminal work of “Taking bribes” the indictment charges accused Ramadan Ukzmajli, Bahri Baliu, Ahmet Bajraktari and Naim Avduli, for the latter, the prosecutor on December 11, 2023 has been withdrawn from prosecution (XI slide of the July 5th 2021 indictment).
While, for the criminal record of “Brits” accused Isuf Cerkini, Ali Kosumi, Rasim Avdyli, and Heset Neziri, for this latter prosecutor on December 11, 2023 has been recalled from prosecution (positive X XIV of the indictment of July 5, 2021.
