Generally these are the elements of this Draft-Statute:

  1. The association is called: Kosovo Serb Major Community Association
  2. Association headquarters will be in northern Mitrovica unless member municipalities decide otherwise
  3. Draft-Statute has a total of 45 articles and is divided into 7 chapters.
  4. The association, founded with this station, provides a self-management framework for the Kosovo Serb community within the existing municipal level of local self-government and will not gain additional executive competency compared to its member municipalities. The framework includes supporting the delivery of services co-ordinated in specific areas, with the possibility of financial support from Serbia and an effective direct communication channel for the Kosovo Serb community in the Government of Kosovo through the Ministry of Management of Local Power.
  5. The association has legal personality, in accordance with the law in force, and the legal capacity necessary under the Kosovo law to meet its objectives, including the right to possess vulnerable and real estate, to have companies in co-owners offering local services within the scope of association and to link contracts, including labour contracts, as well as lawsuits and indictments.
  6. Association members cannot transfer ownership of their real estate to Association.
  7. Other communities (non-Serbs) should be represented in all bodies of association, reflecting the ethnic diversity of member municipalities.
  8. The association will create its own official symbols, which can be composed of a flag and a coat.
  9. In line with the law in power, the Association will have the right to co-operate within the areas of competencies of its members, with municipalities and institutions, including government agencies, in Serbia.
  10. Such co-operation could take the form of offering from Serbian financial and technical assistance institutions, including equipment, in implementing municipal competencies. Donations of goods and equipment from Serbia will be excluded from any tax or obligation, in accordance with legislation in force.
  11. All financial or other support received from the Association will be subject to the supervision and auditing of the Central Authorities as defined in this station and law in force.
  12. Association can establish relations and enter into co-operation agreements with other local and international municipalities' associations, local authorities, regions and other local self-government units in other states.
  13. The association will be engaged in promoting and protecting the rights and interests of the Kosovo Serb community.
  14. To facilitate the exercise of these competencies, the bodies of association have the right to approve the following:
    b) Decisions.
    c) Declaration.
    d) Work order.
    and guidance.
  15. The association will manage educational and health institutions, which are directly financed by Serbia, in line with specific procedures specified in this Statut and in line with legislation in force.
  16. Kosovo's “Serb Assermous Network of Kosovo” and “The Serbian Health Network of Kosovo” will be established as private education and health providers under the responsibility of association, stressing Serbia as financial contributors, as well as the main offices of these currently established providers in Serbia.
  17. The association will manage the functioning of these education and health providers.
  18. These services will be released from customs and all other duties as long as they provide services in public interest and in accordance with this station.
  19. On the territory of members of the Association, these bidders can use public objects created and co-financed by Serbia for providing health and educational services.
  20. These networks could also be authorised to provide their services in the territories of non-member municipalities.
  21. The Kosovo Serb educational framework” will issue double diplomas. The diploma design (the degree given by Kosovo) given by Kosovo's “Serbian educational framework”, in accordance with the law in force, will be regulated by a separate agreement between bidders and competent authorities.
  22. The founding institution in Serbia will issue a double diploma (Serbian diplomacy). The site of the dual diploma is the city (Serbia), where the main headquarters are. The Kosovo government will handle the dual diploma as valid foreign diplomas.
  • The association finances initiatives related to education, including scholarships, teacher training, research grants, TI solutions, academic exchanges, summer programmes for the benefit of education advancement among member municipalities.
  • The association finances construction and infrastructure projects dealing with offering education among its member municipalities, as well as providing financial support for the maintenance of education and related facilities ( sports halls, IT labs, etc.).
  1. Health and social care:

The association, along with the specific responsibilities of Article 14 of this statue, will exercise full function and oversight (reguide, organize, coordinate and perform jobs) within its municipal competencies dealing with local improvement of primary and secondary health and social care.

  • The association will finance and facilitate the establishment of professional capacities and training of its members' medical and social welfare staff.
  • The association will finance construction and infrastructure projects in terms of providing health care and social welfare.
  • The association will finance social residences in member municipalities.
  • The association will finance or raise funds for support of the social welfare of residents of its member municipalities.
  • The association will finance the purchase of specialised medical equipment, as may be needed by the member municipalities and the Serbian health care framework.
  • The association, through a joint commission with Central authorities, will facilitate paying financial assistance to social welfare from Serbia to beneficiaries living in member municipalities.
  1. In economic development, in addition to other aspects, the Association will represent the interests of members and economic actors located within the administrative border of Association in relations with central authorities, as well as other state and economic operators. in the region and beyond, including those from Serbia.
  2. As far as urban and rural planning is concerned, the Association will exercise full capacity and oversight (reguide, organise, co-ordinate and perform works) within municipal competencies dealing with urban and rural planning.
  • Likewise, the Association will offer legal, hurtful and research advice to Central authorities and their members about the processes of expropriation within the administrative border of association.
  1. Draft Stattuti also talks about returning to Kosovo. The association will approve measures to support the sustainable return of displaced persons and refugees to Kosovo.

Association will also co-finance socio-economic integration programmes for returnees through members. Likewise, the Association will provide advice and support to non-member municipalities regarding their policies and measures regarding the return.

      1. In representing the interests of member municipalities, the Association will promote, distribute and amend issues of the common interest of its members and represent them, including in central authorities.
      2. The association would be able to establish joint public ventures for carrying out municipal services on behalf of its members.
      3. The association will consist of these organs:a) the Assembly.
        B) President and Vice President.
        c) Board.
        d) Council Council Council council council
        e) Administration.
        f) Ankes' office.
      4. The Assembly is the supreme body of association.
      5. The chairman and vice president are elected from the Parliament.
      6. The Adviser Council consists of the maximum of 30 members, including all the heads of the member municipalities. It's an advisory organ.
      7. The Association Board is the leading body of association and consists of seven members.
      8. The board's chairman is Chief Executive Chief of Association.
      9. The administration staff will consist of Kosovo's professional and responsible citizens, regardless of their municipal settlement.
      10. Except for the Ankes office, the Association will provide free legal assistance services.
      11. In the budget, the Association Budget and its expenditures will undergo a five-year period of supervision from the European Union, with the possibility of continuing another five years.
      12. The association will be funded by:
      13. Donations from its members.
      14. Revenues and revenue from services provided by Association, its companies either from its playable or real estate.
      15. Transfers from Central Authorities.
      16. Donations, grants, donations, as well as financial support from Associations and other organisations, domestic and international, including Serbia.
      17. The association will be excluded from obligations and taxes in meeting its objectives, on the same basis as member municipalities.
      18. Kosovo's general audience will conduct external audits of association.
      19. When the Association is established, both the establishment and the initial two-year period of the Association event will be monitored by the European Union. But the European Union could continue to monitor the situation.
      20. The association has the right to initiate or participate in procedures before competent courts, including the Constitutional Court.
      21. In the Constitutional Court, the procedure only exists when association as a legal person can claim to be the victim of violation of fundamental rights and freedoms guaranteed with the Constitution.
      22. There will be an Arbitrazhi Commission made up of three representatives: one of the Central Institutions, one of the Association and the manager with compatibility. If there is no compliance with the Headmaster, then the chairman of the Arbitrazhi Commission will be appointed by the European Union.
      23. To the Regional Director of Police in the North Mitrovica Region, the four mayors of northern municipalities offer the Ministry of Internal Affairs the candidate list for appointment.
      24. As well as, association will be able to advise its members to object to the constitutionality of government laws or acts if there are such claims.
