Tent of millions: The ministry does not allow companies access to Hysen Durmish's dots bid

Periscop reported a few days ago that companies “Kosovo Asphat” are recommended for the contract. The first, owned by Bujar Shaban's son, Deputy Minister Hysen Durmish, and second owned by Shaban's son.

Companies that had cheaper prices and have disagreed with the ministry's decision on the reasons for the removal of the race have gone to the ministry to seek access to the documentation of companies recommended for the contract.

Periscop has learned that the ministry It has allowed partial access to some of the bids, while in the company's bid “Kosovo Asphalt” has allowed no access to documentation at all.

Even in those offers where the ministry has allowed access to documentation, it has allowed only part of the documents to be seen, hiding key documents dealing with technical and financial capacity. It turns out that some companies have sought access to documentation, and none of them have been given full documentation.

The ministry aimed at losing access to complaint

Under the Public Procure Law, as long as it is loaded on e-procurement, the document: “notification on the decision of contracting authority”, which has to make announcements of successful and unsuccessful operators, disgruntled companies can file a complaint in the five-day facility. They should see documentation in this deadline and prepare for complaint within this provision.

Apparently, the Ministry has set out this deadline to lose the possibility of animation to companies.

The announcement was released last Friday afternoon, and the five-day complaint has begun to flow immediately, counting on Sundays, but accessing the request for documentation could be made on weekends.

Likewise, the ministry has not returned answers to access to documentation for this tender, nor has it responded to why it has allowed them full access to all offers and in all the documentation of winning companies. This raises doubts that recommended companies may not have been complete with documentation requested by the ministry itself.

Companies Go to Police

Periscop has learned that some companies not satisfied with the ministry's decision to restrict access to documentation have been addressed to Kosovo police and the Public Procuration Regulatory Commission. - KRPP to get help.

This, as they may only be able to file complaints about the exemption the ministry has made to them, providing clarification that the ministry may have erred when it eliminated them, while they could not file a full complaint on the ministry's decision to reward companies, as they would not know what conditions the companies have not met, as the ministry has not given them offers.

Article 10 of the Public Procure Law. Point 5 says that “Autority contractor, at the request of an interested party, will make and will provide such an interested side with a copy of any material in which such interested side has access to paragraph 3 of this Article”.

Ministry extended the currency of illegal bids

Secondary Public Procureing Legislation (Rules and Operational Guide for Public Procurement) at Article 31 has preceded the Tender Validity.

According to this article, contracting authorities should check the tender file for the required tender value period and specified as the number of calendar days from the deadline for the tenders' delivery. In this case, the ministry has gone that the bidding rate is 90 days.

The rate of offerings can vary depending on the complexity of the tender. So the contracting authority can submit additional time to companies for currency extensions, but it has to send documentation to complete without expired.

Periscope has seen that, the procurement manager has asked economic operators to extend the wave eight days after it expired. In such cases, the procurement organization had completely canceled the procurement process for contracting authorities.

Who was recommended for the contract?

For this tender, the ministry has allocated a total of about 30m euros for three years, and the amount of companies recommended for contracting over 23m euros.
