A. The N is charged that on March 21st 2018, while holding the session in the Kosovo Assembly, in which tear gas was poured, while police searched, she was found a green spray with black dusting parts, reports the “Justice Vow bet”.
Statement about guilt, Minister N. did so at the initial session held Friday, after reading the indictment by prosecutor Merrishe Lluqi.
“Regarding the criminal work I am charged with, and I consider myself innocent, I do not deny that I have had the equivalent of the American Style inscription, I have had the same in the corridor of the Parliament and not in the session hall, however our actions are then political as the deputy of the Republic of Kosovo's Parliament, I have considered it a constitutional obligation and responsibility to protect the integrity and sovereignty of my country<1>, Nagavci said.
After that, Judge Krasniqi-Jashnica informed her of the right to cast out that the indictment and rejection of evidence in the 30-day term.
The second review on the case was scheduled to be held on July 13, 2022.
Initially, this subject was assigned to the General Department judge at the Criminal Division of the Basic Court in Pristina, Ertan Seylla, but the same through an official act of March 2, 2020, had forwarded it to the Randa Crime Department.
“With monitoring acts dated 02.03.20, Judge Ertan Seyfulla from the DP in this court has forwarded the course to DKR”, says the Foundation Court's announcement in Pristina.
As for the SMIL program, the subject was divided to Judge Agim Kuci, who had demanded his exemption from handling this case.
“According to the GJA decision number 495/2021 of the 2508.2021 date with President Albina Rama's decision has been approved by Judge Agim Red's request for his expulsion from this criminal case since he previously took action as judge of the preliminary procedure”, the Constitutional Court in Pristina said.
Currently, this subject is handled by Judge Naim Krasniqi-Jashnica.
According to the indictment provided by the “Justice Vow”, which was established on July 30th 2019 by the Constitutional Prosecutor in Pristina, A. N is being charged with criminal activity “maintaining ownership, control or unauthorized possession of weapons”.
On March 21, 2018, defendant N. unauthorized and contrary to the law on weapons has kept the green spray in possession, with pieces of black spraying with inscription “NATO American Style”
In addition, the indictment reportedly says that as long as there were hearings in the Republic of Kosovo Assembly Hall, where there has been tear gas dumps by some MPs, police to prevent the series of gas launching has physically checked through the bodies of all MPs.
During the body control of the N. defendant, the prosecution's act says she was found and seized high-resolute spray.
With this, A. N is accused of committing criminal work “withholding ownership, control or unauthorized possession of weapons” from Article 374 paragraph 1 of the Republic of Kosovo Penal Code, doing so punishable with fines of up to 7 thousand and 500 euros or imprisonment of up to five years
