Amid criticism and numerous power-opposital clashes, the Kosovo Assembly on February 2nd and 67th had approved the Government's recommendation for granting strategic investor status to the company “Cosmington Foods”.

On this issue, Periscope has also sent questions to MINT for several days, but this institution has not returned answers so far. Not even from the company “

The entire suspicious process

The Strategic Investment Law has entered into force on February 03th 2017, and the deadline for submitting requests by investment subjects interested in involvement in procedures for the benefit of strategic investment status in the implementation of this law has been the 31st December 2020. So that means that a year and a half, the Ministry has not accepted any application for Strategic Investors, because the Law has expired. There were about 50 companies that applied to MINT.

The company “Compacted Foods”, in February 2019, applied to MINT. Investment Agency and Enterprise Support in Kosovo Next - KIESA under the Ministry of Trade and Industry has made the technical assessment of the documentation of the strategic investment project.

After stating that the complete project file was presented and after technical control of the app, the Agency has asked the Interministerial Commission to establish the Operational Group, where the latter has decided to establish the operational Group for preparation, supervision and implementation of the strategic investment project.

So the operational group is responsible for professionally supporting the Investment Agency and supporting companies in following all procedures and preparing all legal documents, with the aim of preparing and implementing the strategic investment project.

The Agency and the Operational Group within twenty days working on the appointment date from the Inter-ministerial Commission, verified the preset documentation and carried out the technical, financial, legal assessment of the project's full file.

Periscopi also owns the Ministry of Trade and Industry's main document, namely the Operational Group document, which after reviewing the documentation has proposed to the ministerial Commission the decision on granting strategic investment status.

The Operational Group that has examined the company's documentation has been composed of eight people, and four have recommended that the company meet the conditions to go to Government for approval, and four of them have ascertained that it does not meet the conditions. So, in a four-in-four situation, the document should not have gone to government. This document, drafted in 13.08.2020, was moved to Government in 2021, a few months after Rosette Hajdari took the lead in the Ministry of Commerce.

So, as seen by the document that Periscopi owns, the signing at Recommand didn't put the principal actors like: Nida Krasniqi from the Ministry of Finance, Shqirkini Grainca from the State Assistant Department, Furkan Erguler from the Regional Development Ministry (the same is currently the head of the MZHR Ministry's cabinet), and Muharrem Kurtaj from the Justice Ministry (Zyra of State Lawyers).

So according to this document, the specified capital value that will be invested within the five-year period is 11, 143, 917.20 euros.

Once lawsuit, then push back

A month after applying for Strategic Investigative Investment, a lawsuit has been exercised at the Basic Court in Pristina against “Compacted Foods” by the Government of Kosovo, the Ministry of Agriculture, Forestry and Rural Development/Kosovo Forestry Agency, Regional Co-ordination Directorate in Pristina.

The indictment has been exercised for disregarding the terms of the contract, namely Article 1, which says the eventual construction on the given land should be a monotony, while the company has built on solid materials.

The company in question has committed violations by building solid material, which is clearly specified in the contract, to establish the assembly object, the refrigerator (with the object and the monitoring environment). The company in question received an announcement from APK- DKR, 811. 2017, in which the Economic Operator has been recalled that it is violating the terms of the contract and the consequences of not complying with the contract, but the same has continued with construction of objects with solid materials. The Strategic Investment Law, which although it has expired with the currency, at Article 14, has also envisioned the revocation of the decision on granting status to the Strategic Project and breaking the agreement.

If, along with the preparation and implementation of the strategic investment project, the Commission receives new evidence on which it finds and confirms that there is false data or change of data in the investment project, on which it would not have been set for granting strategic investment status, the Government revotes the decision to grant strategic investment status; If six months pass by the Government's decision regarding the approval of the agreement on a strategic project and the blame of the investor subject have not begun work on implementing the project; Revocation of the decision on granting status to the strategic project does not free the subject of investment from civilian responsibility for the damage caused by the failure to realise strategic investments -- says the law.
