Justice Knowers Seek Deep Review of State Bureau Bill

In the opinion of the Venice Commission, connoisseurs of the justice system are demanding that the draft law for the State Bureau on verification and confiscating unwarranted property be withdrawn from the Kosovo Assembly to then undergo a thorough review. Movement Speaker Fol, Meddition Demolli demanded that this bill be returned to the point [...]

Movement Speaker Fol, Meddition Demolli demanded that this bill be converted to zero or taken into account all comments recommended by Venice.

“will have to be converted to zero point or will have to take into account all Venice Commission remarks regarding this law. There have also been remarks from the civil society to the minister in this bill that has been sent to hope that the ministry will receive all the comments and address because it is really one of the many comments and addresses that must be taken into account if we want to have a law that will not really violate human rights and be out of the influence of a single political party implementing this constitution, Demoll said.

Demolli urges the ruling party to form a working group for the State Bureau, including opposition parties.

“This should return, I believe, is as important as Vettingu and the ruling party must do more to reach a political consensus even with opposition parties to form a broader working group and consider the comments of all”, he stressed.

And, Jeton Hasani of the Kosovo Institute for Justice (IKD) said that the Venice Commission's remarks to the draft law for the State Bureau are serious and very large.

He demanded that this bill be withdrawn from the Parliament and undergo a thorough revision.

The “Coments the Venice Commission gives to the Bureau bill are comments with extremely serious and serious remarks on almost every important aspect of this bill. It's important that the Venice Commission has in principle approved the concept of the civil mechanism of unwarranted property seizure, but the details in the law of how this system is proposed to function are highly problematic according to the Commission in terms of human rights and rule of law, where according to the Commission violate both the country's Constitution and the best international standards, in this sense a profound revision is needed, and the first withdrawal of the bill on the part of the government because the bill is only in the country, as well as to make a deep revision of that bill is incompatible to the constitution and the judgment of Venice, so it needs to be highly dependent on the problems and fundamentals of the government itself, the Bureau of independence, then, Hasani.

Although the Venice Commission deemed it legitimate to establish the civil mechanism of confiscating unwarranted property in Kosovo, the Commission finds this bill fails to respect even minimum human rights standards and rule of law.

According to Venice, it is essential that regardless of the legitimate purpose of this move, the same should be in accordance with the country's Constitution and European standards, in particular in the area of human rights and rule of law.

The Commission also questions the very need for the creation of a special institution such as the Bureau. Although it is not positioned whether or not to be created, the Commission issues whether the creation of the Bureau would make the fight against corruption more efficient or simply complicate the current system. However, numerous remarks have also addressed the standard of testing in the seizure procedure.

The Venice Commission has also published opinions this week regarding the process of vetoing the justice system in Kosovo.

Kosovo Assembly Chairman Glauk Konjufca had submitted the draft to the Venice Commission for the establishment of the State Bureau for verification and confiscation of unwarranted property sponsored by the Ministry of Justice.

As a bill in Government, however, it passed on December 29, 2021.
