“Azem Syla and others declared innocent of corruption and organised crime

Former President of The PDK, Azem Syla, has been declared innocent Friday on charges of organised crime, money laundering, bribery and other criminal acts in the case known as “Toka”.

Just as Azem Syla has been declared the other accused: Arton Vila, Ramadan Uka, Avdyrrahman Brajshori, Shpresim Uka, Shaban Syla, Gazmend Gashi, Ramadan Mavruj, Nrue Palushi, Sami Macedonci, Nyrtenne Brajshori, Lumnije Sopojan, Elheme Uka, Lubisha Vujoviq, Avni Maxhu, Sabedin Hadziu, Ilaz Syla, Vidav Novakovic, reports <x0Betimi for Justice<1>

In this session, which is being held at the Constitutional Court in Pristina, the accused Fahredin Gashi has not been declared with his lawyer's reasoning, Gezim Kolzak, that his client has psychiatric expertise that proves he is unable to understand the indictment.

Meanwhile, the session is continuing with the opening word because the previous day had failed sessions because Azem Syla had not been regularly invited.

In this case, former Kosovo Democratic Party deputy (PDK), Azem Syla and others from 2016 are being charged with various criminal acts related to corruption and organised crime,

Initially in this case there have been 22 indictees, where for the N.U., and the U.M., procedures have ceased after they have changed their lives, while because the court has failed to ensure the presence of Ilaz Syla, Mustafe Halit and Hajrullah Berisha, procedures have been set aside for the same one.

The judge has joined the criminal procedure against Ilaz Syla, who has been charged in the case.

Likewise, it has joined the procedure against accused Vidosav Novakovic now, saying that a lawsuit will be taken in this criminal case since, according to him, related evidence is and the case is the same.

Otherwise, the subject was first judged by Judge Becir Kaluldra, and since the judgment was near to its completion, the advance of Judge Kaluldra had contributed to the failure of the subject.

The Constitutional Court in Pristina had later set the case to work by Judge Hope-Heysen, who had not held any hearings.

But even after the case was almost final, when judged by Judge Kaluldra, the same one must begin again. This is after Article 311, paragraph 3 of the Penal Procedure Code stipulates that: “when the delay has lasted more than three (3) months, or when the judicial examination is held before another chairman of the panel, the trial should start again and re-evaluate all evidence”.

Based on the Code of Criminal Procedure, all evidence of witnesses, indictees and other evidence that has been examined by Judge Kaluldra must be reviewed once again from the start by the new chairman of the court, Arben Hoti.

Otherwise, this review from the beginning of the trial has been characterised by procrastination, to a greater extent, at the time it was judged by EULEX judges.

The Special Prosecutor of the Republic of Kosovo (PSRK) has filed two charges, one with 17 people and the other with 22 persons, which, in the latter, was established on October 24th 2016, includes the former delegation. PDK Azem Syla, who according to the SPRK, had also been leader of this group.

Along with Syla, Shaban Syla, Arton Vila, Fahredin Gashi, Shpresim Uka, Ramadan Uka, Avdurrahman Brajshori, Gazmend Gashi, Ljubljana Vujovic, Sabedin Hadziu, Avni Maxhuni, Elhame Uka, Lumnije Sopojani, Nirne Brajshori, Sami Macidonci, Nsu Palushi and Ramadan Mavrej.

Part of this act has been N.U., U.S., Ilaz Syla, Mustafe Haliti and Hajrullah Berisha, but for the first two, procedures have ceased after they have changed their lives, while because the court has failed to ensure the presence of Ilaz Syla, Mustaf Halit and Hajrullah Berisha, procedures have been set aside for the same.

But, Judge Hoti, outside the session has joined the procedure for accused Ila Syla and Vidosav Novakovic, where he has said the evidence is interrelated and the case is the same.

The instance charges the defendants with criminal acts “organised”, “money laundering”, “receive mics”, “heavy malming”, “duty “, “reference to counterlegal judicial decisions”, “The bad use of the official post”, <x14delegisation of the counterfeit context <x> and <x16166>

The defendants are also charged that, in co-operation, through criminal activities, they have deprived Kosovo of social property, including forging official decisions and documents, fraud and other corrupt actions.

Investigations in this case were also made in co-operation with the High Prosecutor for Organised Crime in Belgrade.
