The ombudsman in the opinion published Friday afternoon on the issue of same-sex marriage has supported the latter, saying it is guaranteed constitutional right.
Opinion has been sent through a media communique, which envisions that “the deprivation of people with same sex from the right to marriage is a violation of the right not to be discriminated against on the basis of sexual orientation”.
However, from the ombudsman Institute, they have requested that, under the Civil Code, the recognition of same-gender persons' relations is expressly defined.
Moreover, the ombudsman estimates that the current formulation of the Civil Billing for allowing registered civil communities among persons of equal sex, without clearly defining what a registered civil community represents, and by specifying that conditions and procedures for recognition of these communities are regulated by special law, does not provide solutions, and does not reflect guaranteed rights with the constitution of”, the communique is said.
It was not two months ago that the Civil Billodi envisioning co-existence among same-gender people, where 29 of the 61 MPs who were participating opposed it.
Even several deputies of the ruling Vetevendosje Movement had emerged against this Code. One of them was MP Labinote Demi-Murtezi, who said she opposed allowing the union of the same gender.
Likewise, Bosniak community MP Duda Balje opposed allowing the registration of the union of the same gender, saying this is only because of integration into the European Union. According to her, this is contrary to the tradition and culture of Kosovo families.
Regarding these statements and the opposition of the Civil Billod had reacted to the US Embassy and the QUINT states, urging the Assembly to support this initiative.
