The Council for Protection of Human Rights and Freedoms (KMDLN) has called on Kosovo Assembly deputies today, in one of the following hearings to discuss the status of those arrested at the Special Court, who have legal protection but are not protected by human rights.

A media communiqué says the Kosovo Parliament's Human Rights Commission should take concrete action on this issue, while KMDLNJ is willing to testify before this Commission and present parts of the long-term monitoring report.

KMDLNJ says it has applied to the Special Court for monitoring visit, but it was not allowed, which according to it is contrary to the monitoring mandate signed with the Ministry of Justice.

While for visits by Justice Ministry officials to The Hague KMDLNJ says they are more symbolic, commemorating that there is a difference between informational visits and monitoring visits. In the informative visit account for family visits, friends, the Kosovo Ombudsman's only visit and two visits by the Ministry of Justice.

“The visas of MD officials are more symbolic of the attempt to demonstrate an institutional authority which in this court has zero effects and clearly does not match the mandate it has in Kosovo's justice system, which has no impact on improving conditions for arresting”, it is said in communiqué.

Currently, eight Kosovo citizens -- all former KLA soldiers -- who founded the KLA and gave meaning and restraint to the war for freedom and liberation of Kosovo and who after the end of the war were top holders of institutional and state posts.

Charged are Jakup Krasniqi, former head of Kosovo Assembly Hashim Thaci former prime minister and former Kosovo president Kadri Veselini, former Kosovo Assembly Speaker and Kosovo Speaker The PDK, Rexhep Selimi ão GP head of LVV ʹ, Hysni Gucati, head of KLA OVL, Nasim Haradinaj, vice chairman of KLA OVL, Salih Mustafa, former BIA leader and Peter Shala KLA.

The Special Court is, in effect, part of Kosovo's justice system, while in fact, nothing is proved to be so, but nothing is identified as such. The Special Court by annexing the entire decision-making agreement has carried over itself by removing Kosovo and the justice system from any authority and decision-making, even for its citizens currently held hostage in this court.

This Court's work has been devised in such a way that even if the accused are violated the human rights they are entitled to as being deprived of freedom these violations have nowhere to be addressed. Currently, the Special Court has granted exclusive access to monitoring the International Committee of the Red Cross, which, due to commitments and methodology, did not make regular monitoring and Ombudsperson of this Court, a stupid post that has a warrant for employed persons' rights in this tribunal, and not for arrest. These visits are called special visits, while others are family visits, regardless of the post or quality of the visit.

The opinion should be clear that there is a great difference between informative visits and monitoring visits. In the informative visit account for family visits, friends, the Kosovo Ombudsman's only visit and two visits by the Ministry of Justice. KMDLNj has filed a request to the Special Court for Monitoring Visit, but that this visit was not allowed at a time when the family visit for KMDLNj is unacceptable and contrary to the monitoring mandate it has and contrary to the agreement signed with MD ʹ which has failed to provide access to KMDLNj's monitoring agreement. It seems obviously that the MD does not present any authority near this Court, so those arrested, citizens of Kosovo are deprived of basic human right to be visited during their stay in custody in this non-transparent and closed environment for monitoring KMDLNj, with a more than 20-year experience monitoring the rights of persons deprived of freedom. Three basic conditions, professional competencies' competencies, confidence and acceptance of those deprived of the freedom to visit must be met, and co-operate with monitoring and third condition, willingness and will of the maintenance institutions, in the concrete case of the Special Court allow and enable monitoring. In the concrete case of the deprived of freedom are very willing to accept in regular KMDLNY monitoring visits, KMDLNI monitors were and are at any time willing to make these visits because it is the request of those deprived of their freedom and family members, but that the Special Court has clearly defined the KNKK monopoly from Geneva and the so-called Special Court's Obligations for Monitoring, which is neither effective nor in line with international standards for the fact that we have no improvement of principle and efficiency and implementation of procedures.

The visits of MD officials are more symbolic of the attempt to demonstrate an institutional authority, which the Court has zero effects in this case and clearly does not match its mandate in Kosovo's justice system, which has no impact on improving conditions for those arrested. Therefore, KMDLNj expects and calls for Kosovo Assembly deputies in one of the next hearings to discuss the status of those arrested at the Special Court, who have legal protection but are not protected by human rights. The Kosovo Parliament's Human Rights Commission must take concrete action on this issue, while KMDLNj is willing to testify before this Commission and present parts of the long-term monitoring report. Those held hostage at the Special Court are Kosovo citizens and are considered innocent until a decided verdict by the relevant court.
