Dexter Wilton's body was found by doctors inside a property in Racevia in Ipswich on June 21, 2019.
His mother Natalie Jade Whitehead was charged about 18 months later with murder. Her partner at the time, Andre William Campbell, allegedly lived in Ipswich's house when the child died.
Campbell and Whitehead had been in a relationship for about six weeks by the time Dexter died, the Supreme Court was told on Wednesday.
They were no longer together when both were arrested.
Prosecutors said during Campbell's application for release on condition that the 42-year-old is currently accused of neglect.
There was no claim from the material presented that Campbell had been violent toward the child, the judge was told.
Prosecutors will claim Campbell and Whitehead were in a consumption of three or four days of drugs and simply forgot about the baby that caused his death. Crown also argued that Campbell “mangi deliberately police for more than two weeks” before his arrest in January last year.
The parole application has been postponed for Wednesday afternoon.
