According to MSHA, on December 15th of last year this institution has signed a contract with the Madekos company for supplies in surgical masks and gloves. The contract price is 150535 euros at a three-month period.
So by KDI. The USKKUK has accepted higher prices than the bids accepted by the same company for surgical masks. Madekos has offered 0.03 euros in the open tender, while in the tender with negotiated procedure, 0.04 euros.
“SHSKKUK has invited only one more company to offer in the negotiated procedure, but has given a higher price. As a result of limiting competition, the USKKUK has accepted higher prices. There is also no evidence that the USKKKK has attempted to negotiate to lower the price. Using the negotiated procedure without publishing the contract, implies that the contracting authority should try to negotiate and lower the” price, KDI says.
Full announcement:
On December 15th 2021, the Kosovo University Clinical Hospital Service (SHKSUK) signed a contract with the Madekos Company for supplies in surgical masks and gloves. The contract price is 150535 euros at a three-month period. The USKKUK used the negotiated procedure because the open tender for the same products is in complaint with the Procuratory Organisation. However, SHKSUK has not invited all operators who have offered in the open tender to bid also in the negotiation tender. S HSKKUK has accepted higher prices than the bids accepted by the same company for surgical masks. Madekos has offered 0.03 euros in the open tender, while in the tender with negotiated procedure, 0.04 euros.
Price comparison in negotiated, open tender

SHSKKUK has invited only one more company to offer in the negotiated procedure, but has given a higher price. As a result of limiting competition, the USKKUK has accepted higher prices. There is also no evidence that the USKKKK has attempted to negotiate to lower the price. Using negotiated procedure without publishing contract reporting implies that the contracting authority should try to negotiate and lower the price. SHSKUK has had to invite all OE who have offered in the open tender in order to receive cheaper prices. One of the basic principles of procurement is competition, and it has proved that when the level of competition increases, it is more likely to have lower prices.
One of the OE that has participated in the open tender, Ardi S. The P.K has complained that it has not been invited to participate in the negotiated tender and that it could offer these products at the price of 90,000 euros, or about 60,000 cheaper than the contract price. If the contract were to be calculated with prices offered in the open tender, then USKKUK would pay around 18,000 euros. A well-advanced decision to use the negotiated procedure and to be invited only two OE has the USKKUK damaged its budget for about 42,000 euros.
