“I've been beaten up to allivanation”,” Everything was done at the order of the accused”, witness words to Salih Mustafa

At the beginning of questions for the witness from the Special Prosecutor's Office, the session has been coming and closing for a few minutes, to then proceed with testimony from the witness at the open session.

There, the witness said it was first stopped by two people where two others had then arrived in a car to pick up and then sent to Zlata.

The witness has said the people in question were KLA military police and, according to him, one had a red hat.

Only one of them had a red hat, a red hat had... Two people were on the car, one of them had a red hat... ... they didn't leave me without a look at”, the witness said from where the prosecutor was asked if the people in question had any emblems.

He said they gave him a chocolate and they beat him and then he thought they put a black bag in his head.

The Witness said that he was sent to Zlata, which he claims is about 7 or 8 minutes away from where he says he was taken.

The Witness said that he was sent to a stable first, then said that he was thrown out and beaten for several hours.

I've got the bag in my head... and I've been taken to that room when I went to the door to kick, I fell, I didn't see, then there's more coming, and I don't know, so I've been taken to another place outside and they've got cold and beat up, said the witness.

Until the prosecutor asked him how many people were involved in this beating that the witness was talking about, he said there were four or five people but he was with bags on his head and didn't identify them.

I can't believe I've been beaten in days because I've been a couple of times I've been allivanized, I've been brought wood, I've been kicked, I've been brought, I don't know what, my finger's broken, my teeth are broken up, I'm hurt, we've had surgery. I didn't know with a bag in the head I was... I've been beaten to the ground. I've been shot down. I've been shot down. I've been picked up.

According to the witness, one of the people in a moment had his foot on his head while he was lying and pointing a gun at his forehead.

I've been lying on... I've been hit by a gun, I've got a gun shot in my face.

While the prosecutor has asked who was the man who had pointed the gun at him, the witness has said that “was the accused” who did not mention his name.

This is the man who, the accused is. This guy who's charged with shit. There was no nickname back then, you know, a red hat. I don't know anything, I haven't seen, the dark is fine, this person knows. I know he's in charge. ... Without saying the accused they didn't do anything, the other soldiers, the accused had the lead, and he had them, I didn't see that they were dark I didn't see”, the witness said.

The first witness in Salih Mustafa's trial is testifying under protected security measures where his identity is not known to the public and has set a curtain that prevents accused Salih Mustafa from seeing the witness.

Early in the session, Salih Mustafa has demanded the word, but from the judge she is told there will be another case during today's hearing to give her word since once she will attend hearing the witness.

Today's hearing attended by the first witness has been continuing and closing for a few minutes, and in some parts there has been editing during the broadcast.

This is the first judgment to have started in Kosovo's Specialised Chambers in The Hague, and Salih Mustafa is the first arrested by the Special and standing in custody since September 2020.

The Act against Mustafa was confirmed on June 12th 2020, as he was arrested on September 24th, with war crimes claim, and sent to the detention facility in The Hague.
