Court condemns former police station commander in Gjakova, four other officials for beating one

The Constitutional Court in Gjilan has declared a conviction court against the former commander of the Gjakova police station, Christa Gjona and four other police officials, for carrying out criminal work “mishandling during the exercise of official office or public authorization”. The court has confirmed that the same were physical violence against the injured M.R., even though it was bound by hands.

As the court reports, Report Express, the trial body of the Randa Crime Department has pronounced prison sentences for accused Christa Djoka during the 120-day term, while, with the consent of the accused, his sentence is replaced in fine sentences of 2,000 Euros.

“indictees G. B. and A. I. They have been sentenced to 90 days in prison, with the consent of the accused, the Court has replaced a prison sentence in fine sentences of 1,000 euros. Indictee M. W. has been sentenced to 150 days in prison, which has been replaced in fine sentences of 1,500 euros, while accused S. L. has been pronounced sentence in length of 90 days, which has been replaced in fine sentences of 700 Euro”, the court reports away.

The accused K. D., being in command position at the Police Station in Gjakova, dated 14,11.2018, about 2:55 minutes, at the D.C. Police Station facility in Gjakova, has now mistreated the injured M. R. from Pristina, in that since the same was arrested and handcuffed, due to suspicion of having committed criminal acts (police report: 2018 A: 1248 and 2018 RHRG 60, hits him with fists in his hand and face, knocks him down on the floor.

With these actions the accused committed criminal work “mishandled during the exercise of official duty or public authorisation”, the work sanctioned with the Criminal Code of the Republic of Kosovo.

Indictees G. B., A. I. and M. W. During office, as police officials, they have now mistreated the injured M. R., in that way that since the same man was arrested and handcuffed for allegedly committing criminal acts in order to reveal information, the injured strike with hands and feet in various parts of the body.

These actions in co-ordination have committed criminal work “mishandled during the exercise of official duty or public authorization”, the action sanctioned by the KPRK.

Indictee S. L. Having been in the position of responsibilities for the Centre for Banning at the Police Station in Gjakova, it has not met official tasks, so that around 4:24 minutes it has enabled indictees M. W., G. B. and A. I. get into the cell where M. R., where he is mistreated, physically assaulting him.

The trial panel of the Randa Crime Department, after explaining all evidence and hearing of witnesses, has pronounced prison sentences for accused K. J. 120 days long, with the consent of the accused, the penalty is replaced by fines of 2,000 Euros.

Indictees G. B. and A. I. They have been sentenced to 90 days in prison, with the consent of the accused, the Court has replaced a prison sentence in fine sentences of 1,000 euros.

Indictee M. W. has been sentenced to 150 days in prison, which has been replaced in fine sentences of 1,500 euros, while accused S. L. has been pronounced a 90-day term, which has been replaced in fine sentences of 700 euros.

In the meantime, accused B. P. has been acquitted of criminal activity “mishandling during the exercise of official duty or public authorization”.

The sides have the right to appeal to this decision at the Court of Appeals.
