Nearly 25 years in prison for drug transportation accused by northern Macedonia in Kosovo and vice versa

The Special Department of the Constitutional Court in Pristina has declared a criminal conviction against indictees Tair Semsij, Alif Bektesh, Sultan Rashi, Fidan Rashit, and Ali Rrustemi, condemning them to 24 years and 6 months in prison and 12 thousand euros in fines. The five accused are charged that by acting in a group led by accused Semsij, they had mediated and transported marijuana-type narcotics from the Republic of northern Macedonia to the Republic of Kosovo and vice versa, to send it away to various European Union countries (BE). Becketshi, however, is also being accused of illegal weapons.

According to the trial pronounced Tuesday by Judge Valbona Musliu- Selimaj, accused Semsij has been sentenced to 6 years in effective prison and 3 thousand euros in fines, reports the “Justice Vought”.

Bekteshi has been sentenced to 5 years in prison and 2 thousand euros in fines for narcotics, while for illegal possession to 8 months in prison. As a unique sentence, the court has pronounced 5 years and 6 months in prison and 2 thousand and 500 euros in fines.

The court, Sultan Rashi, has sentenced him to 5 years in prison and 2 thousand euros in fines, while Fidan Rashit was sentenced to 3 years in prison and 1 thousand euros in fines.

Ali Rrustemi, on the other hand, has been sentenced to 5 years in effective prison and 3,000 euros in fines.

In addition to higher sentences, the court as a supplementary punishment for the accused has permanently confiscated the playable items as tools that have enabled the conduct of criminal acts and items that automatically submit to the seizures that still exist under the court's decision.

Judge Musliu-Selimaj has announced that those accused of being spent time in the amount of detention would be counted in the sentence pronounced in prison.

The accused are also obliged to pay exclusively from 100 euros on behalf of the judiciary and 50 euros for the crime victims' funding.

The court has also continued the detention measure of accused Tyr Semsij, Arif Bektesh, Sultan Rashitti and Ali Rrustemi, while accused Fidan Rashiti has interrupted the move.

The disgruntled side has the right to a 15-day complaint between the day of receiving a copy of this act.
Otherwise, the accused were also charged with criminal acts “organised crime”, but against the same, prosecutor Habibe Salihu, in the final address, had withdrawn from prosecution for this criminal act.

According to the indictment filed on May 7, 2021, Tahir Semsij, Arif Bektesh, Sultan Rashit, Fidan Rashit and Ali Rrustemi are being charged with organised crime in connection with criminal work “Blerje, possession, distribution and unauthorised sale of dangerous narcotics and psychotical substances”.

But, after the prosecution's re-qualification, the same is being tasked only with criminal activity “Blerje, possession, distribution and unauthorized sale of dangerous narcotics and psychotropic substances”.

The indictment states that the accused during 2020, acting as a structured group led by accused Tyr Semsij, have mediated and transported marijuana-type narcotics from the Republic of Northern Macedonia to the Republic of Kosovo (RKS) and vice versa, to send it away to different European Union (BE) countries.

Always according to the indictment, accused Sultan and Fidan Rashi were tasked with bringing narcotics to Kosovo and handing it over to accused Ali Rrustemi, who had to be supplied with quantities of narcotics and send it to EU countries.

The prosecution claims that during 2020, accused Rashi had met with the accused Tair and another unknown person in Skopje and accused Semsij, he had given the accused Fidan keys of a car filled with narcotics in quantities of 47796.03,025 grams, in order that through the unidentified person be sent to the home of Sultan Rashi to keep him until the next day, where Tair Samsiji was then accused of handing him Ali Rrus to the EU transportation.

On the other hand, in the accusatory act, it is said the next day, December 12, 2020, at the USKKUK court in Pristina, until accused Fidan Rasiti and Tyr Semsij were carrying the narcotic from the car that the accused Fidan drove to the accused Ali's car, were caught in adultery and arrested by Kosovo police, while accused Sultan had been monitoring the situation from a distance and noticed police managed to leave the scene.

While, according to the prosecution, accused Arif Bekteshi had the role of interacting with the accused Tair to assure those who would transport the narcotics, negotiate with them and offer suggestions and observe the area from which the amount of narcotics was to be carried.

The prosecution, Bektesh, is also burdening the criminal work “to be held in ownership, control or unauthorized possession of weapons” by Article 366 par.1 of KPRK, so that, according to the prosecution, on December 12, 2020, at his home in the village of Lubisht, the municipality of the Year was found and confiscated by Kosovo police a hunting gun, two barrels and 32 rounds of various calibres. /Betimy for Justice
