An indictment of Mimoza Kusari, Besim Beqaj, Nenad Rasic of Arben Djuk

The Special Prosecutor has filed charges against former ministers Mimoza Kusari Lila, Besim Beqaj, Dardan Gashi, Nenad Rassic and former KEK director Arben Djuka, for the case known as the Faleration of hydropower plants.

The Special Prosecutor of the Republic of Kosovo has filed an indictment today at the Constitutional Court in Pristina, the Special Department, against nineteen people.

The Act against Besim Beqaj, Mimoza Kusari, Dardan Gashi, Nenad Rasqi, former KEK director Arben Djukka, and 14 other people: F. H., F.C., M. R., A. N., F. C., I. I., G. J., B.B., G. Sh., N.H., A.A., B.H., K. B., and L. F. for criminal work “Using official position or authority” by Article 422 paragraph 2, concerning Article 31, the Criminal Code of the Republic of Kosovo.

“Special Prosecutor announced that defendants B. B. Government Committee for Privatisation leader M. K., N.R., D. G. and L. F. Members of the Government Committee for Privatisation, members of the Government Privatisation Committee (KQP), in terms of official persons, in order to enable any rich benefit to the other person and to cause harm to the other person, have exceeded their competencies, acted in opposition to their assigned tasks and rights as members of this committee, as by the date 08.05.2013, they have unanimously voted that hydropower plants that produce power such as Lumbard hydropower, hydropower plant plant, Burim Hidroctil, and Racitrectil <2doc> to transfer to the plant. KKKDFE and then privatised by company “Limak-Calick””, the Prosecutor's Office reports.

Also, the same day, the agreement on imports, for transfer, for supply, for implementation, has been signed for debts. With the signing of these agreements closed the privatisation process of the KKDFE, despite the fact that the same agreements had not to be transferred and privatised, because such action prohibits legal bases, the Law for Electrical Energy regulator No. 05L-084, Article 35, paragraph 4, the same assets have been under concession, as well as the recommendation of the IFC has been to remain in the KEK framework, with these actions the same as, the same actions, the same as the EC company's interests as the Kosovo Republic of Republika Government, only specific ones for the remaining periods of much of concession, because the EC needs to be paid for the same privatisation, and the company's non-composed, or privatisation, or privatisation, or privatisation, the same company's, or privatisation, or privatization, or privatization, the same company's, or privatisation, or privatisation, which is said the same.

Further in the report, the other damage directly caused is invested in hydropower plants of 12,628,166.41 euros, which did not include the value of pre-coension assets, because KEK has not done the census and has not presented the value of pre-privation assets, but privatisation is made according to the value of means based on the 2003 census, which still continues to be caused permanently.

The prosecution claims that with these actions the defendants in co-ordination have committed criminal work “The use of official position or authority” by Article 422 paragraph 2 concerning Article 31, the Criminal Code of the Republic of Kosovo.

“H., in the quality of the official-man manager in the project for privatisation (NJIP) authorised by the Ministry of Economic Development ( MZHE), A. G., in the quality of the official person . Director Manager at the Kosovo Energy Corporation (KEK), B.H., in the quality of the official person- co-ordinator for KEK's decomposition, and the defendant K.B., in the quality of the official person .C., member of the Board of Electrical Regulatory Office (ZRRE), once delegated to the KQP, as representative of ZERERE, each separately, in order to provide whatever benefits to the rich and other person that causes damage to their own owners. With these actions top defendants have committed criminal work “The use of official position or authority” by Article 422 paragraph 2 of the Republic of Kosovo”, the report said.

“While, defendant F.C., in the quality of the official person of the KEK Board, M.R., A.N., F.K. and I.I., in the quality of official persons-members of the KEK Board, as well as G.J., in the quality of the official person of the KKFE Board, B. B., G.S., N. H. and A.A., in the quality of official-members of the KKDFE Board, using official duty or authority, in order to enable any property benefits and to cause harm to the other person, have exceeded its competencies”, the Special Prosecutor announced.

The prosecution also reports that high-ranking defendants, in co-ordination, committed criminal work “The use of official position or authority” by Article 422 paragraph 2 concerning Article 31 of the Republic of Kosovo's Criminal Code.

KED's privatisation was wrapped up with May 8th 2013. Four hydropower plants were secretly privatised along with the distribution and power supply. Their involvement in the tender package was kept secret, while ministers who have made key privatisation decisions have declared that they have not been informed that the package is included in the sale of hydropower plants.

Four hydropower plants have been sold along with KEDS -- theDicence hydropower plant, the Source, the Radovac and Lumbardhi hydropower plant.

They have been granted concession by KEK with the aim of restoring them and increasing production capacities. At the time they were rented, according to KEK, they had an installed capacity of 11 megawatts, but concessions have pledged that after investments making their capacity would increase to 14 megawatts.

If the communiques issued by KEK are seen, at the time of the delivery of these concession plants, it turns out that 15m euros have been invested in them.

It was reported that the plants were part of the asset list, but only the components of the plants were written. The newspaper Life in Kosovo has analysed the asset list, only in the section of hydropower plants.

The long list of assets has also included components of hydro power plants. In the entire long list of assets in one country only writes “HCV”, which is acronym for “Hidrorals of Vogla”. Nowhere else on this list does the word hydropower work.

The Act has been set up for the forgiveness of four hydropower plants during the privatisation of the KEK distribution network, the process developed during the Thaci Macedonia 250. Four hydro power plants were involved in firing the distribution without being part of the increase.
