The collapse of the Government of Kosovo with the no-confidence motion in the country dictates the need to form the new government, new elections or even continue to operate this government with limited competency for a time until the alarming situation with COVID-19 continues.

The Kosovo Assembly has already voted the no-confidence motion on the government led by Prime Minister Albin Kurti, with 82 votes for 32 against and a abstention. The motion was established by the Democratic League of Kosovo, which is part of the government. Currently, the government is withdrawn, but in office.

Recognition of the political developments and the functioning of the Kosovo Assembly, Albert Krasniqi, told Radio Free Europe that after the no-confidence motion was successful, the government remains in office until the new government is elected.

“Whether it will be a technical or multi-party government, it will depend on the will of MPs, but also on the president who can decide through a decree that the country go to the elections”, Krasniqi said.

In the Kosovo Constitution, its 100th article says that if the no-confidence motion is voted into Government as a whole, the government is considered in resignation. Article 82, however, stipulates that the Assembly can be distributed by the president after the government's successful vote of no-confidence.

Currently, Kosovo as well as the world, is facing the pandemic of COVID-19, following the spread of the new deadly coronary. Thus, organising elections is not believed to be possible under current circumstances.

Vogan Qrolli, professor of International Law at the University of Pristina, tells Radio Free Europe that following the adoption of the no-confidence motion, the country's president will seek the winning party of last October 6th elections, [in this case, Vetevendosje Movement] the name of a new mandate for prime minister.

Qroll also stresses that it is the other possibility that all political parties sit at a table and find a solution which, according to him, would convince the president to vote or nominated a candidate for prime minister.

The Constitutional Court's verdict requires that there be a consensus and of this a joint assembly of all parties in order to convince the president of a common solution. But he [ president] does not rule out once again the possibility of nominating a candidate from the winning party, Vetevendosje means, but no longer Albin Kurtin mandated”, Qrolli said.

Article 95 of the Constitution of Kosovo writes that “if the prime minister resigns or for other reasons, his/her post remains at large, the government falls, and the president of the Republic of Kosovo, in consultation with political parties or the coalition that has won the majority in the Parliament, mandates the new candidate, to form Government”.

That definition is believed to give the right, at least the first time, to Vetevendosje as the winning party to propose the new prime minister's mandate.

But, according to Faran Qrolli if the most voted party voluntarily abandons the prime minister's position, then the president could pass the line to other parties after the VV.

“There is not expected to be a technical government, there will be a political government that will pass a several-month transition and then new elections that have to be held, we are saying, within a reasonable period of time, after the pandemic may pass in late September”, Qoroll said.

The chairman of the Democratic League of Kosovo, Isa Mustafa, has declared that as a party it is open to talk again with the Vetevendosje Movement, but according to him, now for a broader government, where other political parties would join.

Mustafa has said that the LDK's stance continues to be the same, meaning that the LDK does not only want the Democratic Party of Kosovo in the new coalition.

Analyst Albert Krasniqi says the PDK, based on its leader's statements, Kadri Veseli, prefers to stay in opposition.

If we rely on political party statements, The PDK has declared it will stay in opposition. So, even if a new government is created, which comes out within the current composition of the Assembly, will not be multi-party or technical”, Krasniqi said.

Meanwhile, analyst Imer Mushkolaj thinks Kosovo is entering a new political crisis.

We'll probably have a government with a limited mandate. After all, though, citizens were abandoned in a difficult situation. Politically, the biggest loser in this situation will be LDK”, Mushkolaj told Radio Free Europe.

Kosovo's current government, led by Albin Kurti, has suffered fluctuation due to disagreements that have emerged between the two partner coalition parties -- the Vetevendosje Movement and the Democratic League of Kosovo.

The disagreements between them culminated in Kosovo Prime Minister Albin Kurti's decision to dismiss Agim Veliu from the post of Minister of Internal Affairs and Public Administration, which comes from the ranks of the Democratic League of Kosovo.

The latter later initiated the no-confidence motion on the government, providing signatures by opposition deputies. Following the government's collapse, incumbent Prime Minister Albin Kurti has dismissed the post of prime minister, Avdullah Hoti from the Democratic League of Kosovo.
