Fatmir Limaj rejects KDP agreement, submits indictment for compensation
As for compensation for the damage, Kosovo Judiciary Council spokeswoman Aish Qorray has said Fatmir Limaj has not accepted the agreement by KDP, and whether KDP has been indicted, we still have no information.
“Fatmir Limaj, as you described, Mr. Limaj has not accepted the agreement by the KDR, but if the KDR has been indicted, on this matter, we have not been officially informed of”, Qorraj said.
Lawyer Rattle: It's been over two years since we handed in the indictment for damages compensation.
Meanwhile, Fatmir Limaj's lawyer, Tahir Rrecaj, has said that more than two years have been in place for us to hand over the damage compensation indictment in case “Klicka” and we are still pending.
We have filed charges for compensation of material damage and not material, and the indictment has been handed over to the Constitutional Court, and we expect the solution that we have handed over for more than 2 years, but we're on hold, so it's a civil indictment, that's a requirement for compensation for the damage, in case of “MTPT”, we haven't filed a lawsuit”, attorney Tahir Rrecaj said.
Likewise, Rrecaj has added that, Fatmir Limaj has not expressed interest in extending the indictment for the “case. MTPT”'s, and they're still waiting for the courts even though they're not as efficient.
“We thought when to return to the Court of Appeals, the case of “MTPT”, to expand the indictment or not, but Fatmir has not expressed interest, so we can expand the indictment during the trial, but I don't believe, but only the “Klica” case remains, and for the existing indictment we have not yet filed suit. We are awaiting courts, courts are not efficient enough, and there have been more than 2 years since the indictment has been handed over and we have not received calls and prepared sessions have not been scheduled yet, so we are awaiting”, Rhecaj said.
Compensation, lawyer Gashi: Prosecutors Must Take Responsibility
The renowned lawyer of many major cases, Tome Gashi, for the Jews.info, has said those who are acquitted of unlawful legal charges or who have been prosecuted have the right to retaliation.
All those released from the illegal legal charges, or simply stated that they are released or not charged at all, but that have been under law-based prosecution and justice have the right to reparation, and that is right that can't, nor should anyone be denied,”, the lawyer Gashi said.
Gashi has added that these cases do not harm the state budget, but that prosecutors who accuse without facts and in certain cases without grounds the detention, and therefore must take responsibility for those prosecutors who pressed baseless charges, and they, according to Gashi, actually damage the state budget by their actions.
“They actually don't harm the state budget, but they did that to the prosecutor who accuses without facts and which is even worse when in certain cases the detention, or the accused person who has even stood in custody, is released innocent, and for that they should take responsibility those prosecutors who brought forward unconventional charges, and that they actually damage the state budget by their actions, while no penalty measure is taken for them, Gashi is indicated.
Economist: Police, prosecution, and court must answer
And, economics expert Mustafe Kadriyaj, for Arbret.info, has said that the problem is justice in the country because even the biggest criminal is declared innocent, but the state camera is the one who appreciates it.
Considering that we are democratic societies I appreciate that the problem is in justice in the country, both in the prosecution and the court because it's natural that even the biggest criminal is declared innocent, but the state device is the one who appreciates it, and in this case the lead investigation should be directed to justice organs for the fact that at the moment he appears innocent and has failed”, Kadrij said.
He also added that the chain range, such as the police, prosecutors and the court, should be held accountable because the problem lies with competent organs.
“The entire chain range, such as police, prosecution and court, must be held accountable, people appointed to those positions for two reasons first for not professionalising to get enough information for the indictment, and once damage to authority because they're doing public shows that are on behalf of fighting corruption and then getting innocent, that's why the whole problem lies in the competent body of”, economic connoisseur Musta Kadriaj said.
