Ramush Tahiri sounds the alarm: No president, Kosovo remains without election, state becomes illegal

Politologist and analyst Ramush Tahiri, in a proposal for the Periscopi Journal, has said the president's issue is emerging to be a kind of political concern and which is alarming if the six-month term passes I can leave the country even without certified elections, and Kosovo as a non-legisation state. This is because of differences between [...]

This is due to disagreements between political parties over the president's name and the need to presence 80 deputies in the Assembly for the vote.

Kosovo was from post-war in a kind of political stalemate on the president's issue, because in any version, the winning party could not secure 2/3 of the votes in the Assembly without any agreement with other parties”, Tahiri told Periscope.

Also, Ramush Tahiri, declares that the leader's task leader, Vjosa Osmani, fails to meet the terms of Article 90, with all dues, she should call the Parliament and distribute it.

“Noni 90, writes decreed that whoever becomes a task leader, Vjosa Osmani has not met the terms of Article 90, the current president, distributes the Parliament, because it is complete, and calls the parties on the election date, and she says, no less than 30 days than 45 days, so it happens only two Sundays, January 5th, February 28, March 7, the choice has to be held. The constitution refers to the president exactly, not the task leader, Article 82 is pretty clear, I don't know why they're waiting, now it has to be a proposal, hold the meeting, and finish this case”, Tahiri said.

In contrast, according to paragraph 3 of Article 90 of the Constitution of the Republic of Kosovo, the post of taskman of the head of the Republic of Kosovo cannot be exercised for a period longer than six (6) months. While, paragraph 2 of Article 86 of the Constitution stipulates that the election of the president of the Republic of Kosovo should take place no later than 30) days before the end of the current president's mandate. Given that, the Kosovo Assembly has time to elect the country's president until April 4th, on the contrary new elections are announced, which must be held within forty-five (45) days.

He has raised a concern, among other things, what if the 6-month deadline is over and the president cannot be elected.

According to him, then the issue becomes problematic and Kosovo turns into a non-legigration state, where elections cannot be certified.

We have a problem, I don't know why the other jurists are explaining it, in 2 months the president has to be elected, procedures start from the day the empty country remains, which is why the president is dead today, 2 months has to be elected. If this is six months, it's the next article, where it explains a month before the mandate is carried out, should the president be elected, now the parliament is distributed, the president is over six months, what is it? Institutions are not worried, then we remain without legitimacy, so who certificate the elections”, Tahiri concluded.

We remember that so far, the parties have failed to agree on the president's name.

The AAK is committed to Ramush Haradinaj, the Social Democrat Initiative, also mentioned the name of its leader, Fatmir Limaj.

Meanwhile, the PDK on the other side opposes those two many names mentioned so far.

And, Vetevendosje has publicly declared that the president's issue should be resolved after the elections.

The LDK is still struggling for a political table to discuss about resolving a name for the new president, but has not yet managed to become possible. /Periscope.
