“The other Special Scandal: issued arrest warrants for president contrary to the Kosovo Constitution”

Guhn Kastrati, political activist, writes that the Special Court also made a scandal by issuing arrest warrants for the president, contrary to the Constitution.

He says that according to Constitutional Court Act with No. K098/11 on the immunity of state officials at 128 says: ” The president can be arrested or banned only after being dismissed, because he/she is no longer a president, but a very ordinary citizen of the common laws. ”

He writes:

The next Special Chamber Scandal

The Special Court has issued an arrest warrant for the president in opposition to the Constitution of the Republic of Kosovo, even though it has jurisdiction of this Constitution.

The Constitutional Court Act with No. K098/11 on the immunity of state officials at 128 says: ” The president can be arrested or banned only after being dismissed, because he/she is no longer a president, but a very ordinary citizen of the common laws. ”

Also in the same court act in paragraph B, below VII, in point 4 says: “The President can't be arrested or detained during his mandate/her due to the nature of the president's post, as he/he is required to be ever available to do them. ”

Specialised rooms have issued arrest warrants for the president by October 26, 2020, while still practicing the presidential post.

This court in any of its actions is killing our country. That's why even this court is unacceptable.
