Two significant developments have come from Special Court Special Chambers in The Hague.
The two-month detention of Sali Mustaf, until Specialised Chambers Prosecutor at The Hague, has continued for two months, has demanded that the trial process against former Kosovo President Hashim Thaci, former head of the Democratic Party of Kosovo Kadri Veselin, Rexhep Selimit and Jakup Krasniqi, begin the summer of 2021, or the most recent September.
Lawyer Skender Musa has spoken about these developments.
Musa in an interview for Klan Kosova has said that this deadline is short for protecting the accused to process the material regarding the case.
He said the prosecution has not handed the full material to the defence.
The Special Procuror of The Hague Court's Special Chambers has not handed all the evidence to the defense, and I can say that as a prosecutor during the five-year investigation, they are informed of subject paperwork, evidence, witnesses and all subject paperwork “.
“On the other side of the accused's defenders are not even equipped now with all the evidence and it's a short term, and it's a short term, because according to the information they're running, it's about 43 thousand pages, and a number of 150 witnesses who have heard “.
It is very difficult to process all the material and provide effective protection. The 2021 deadline is short, but the 2022 deadline is too long, because as it is being seen according to the charges it is dangerous that the accused not be denied custody, or at least some of them. In this regard, the defense request is the most reasonable”.
Lawyer Musa stressed that failing to hand over the material to the State Prosecutor is a violation.
I hope the State Prosecutor's Office will soon hand over the material because with the failure of the material, it violates the Law for Specialised Chambers, the Kosovo Criminal Procedure Code, but also the European Convention and the United Nations Charter. It was a prosecution's duty that all the material be translated into the language the accused understood because the English law language is hard to understand. It was their duty to give every material in Albanian or the language they speak or understand from the beginning of the Special Court. So in this case the Special Prosecutor's Office has violated all of the accused's basic human rights.
According to him, the process against the former KLA quarter may be influenced by politics and major world powers.
Procurators in all systems protect the indictment. And they always want to take less time to do their job and prove themselves guilty. No doubt the Special Prosecutor and Specialised Chambers operating in The Hague are dependent on the Council of Europe, but the world's major powers, such as Russia and China”.
The “may also be political so that as soon as the trial of former Kosovo Liberation Army leaders is concluded, and if the defence and accused are not properly prepared then it is possible to win the accusation side”.
Skender Musa added that none of the Kosovo Liberation Army indictees are intent on escaping or affecting witnesses.
But I don't believe the judge can set a deadline the prosecutor has proposed. This is an obligation. In each country where justice works, there is also the prospect of fleeing suspects, hiding evidence or evidence. But I don't think that any leader of the The KLA, but also Mr. Mustafa cannot influence witnesses”.
Because according to information most of them are abroad. But there has not been a single case or doubt that has attempted to be influenced by witnesses. The names of witnesses are also known after the release of special files. There was no attempt on these people to be affected by them”.
Among other things, the lawyer stressed that the appointment of detention is being made to justify the failure of the Special Court.
According to him after having failed the Yellow House “”, further charges against former KLA leaders have emerged.
