Hague launches shopping for Gucati's release: 5 thousand euros is not enough

The Hague's Specialised Prosecutor has responded to the court's defence request for the legality of their arrest, as well as to the request for release. The Specialised Prosecutor's Office has asked the Prosecution Judge, Nicholas Guillou, to bring down all four defence complaints that require the release of leaders [...]

An action launched by EULEX forces, along with The Hague Specialised Prosecutor's Police in OVL offices- The KLA, had resulted in the arrest of two leaders of this organisation -- Hysni Gucati and Nasim Haradinaj.

At the first information hearings held in court, for various reasons, lawyers had asked the judge to release their clients. Even in his request by Gucati's lawyer, it was promised that the head of OVL will grant as a promise that it will not approach this organization at a definite distance.

But such reasoning is not impressed with the prosecution. The paperwork handed over to the court by the Special Prosecutor's Office mentions that Hysni Gucati had participated in three conferences in which confidential information was distributed.

On at least three occasions, Gucati participated in unauthorized distribution of confidential and non-public information, including names, residential sites, and other details of potential witnesses. Mr. Gucatti also publicly stated that he would continue to do so”, said in the letters the prosecution delivered to the court.

It even states that Gucati was ordered by the court to adhere to these actions and that it was warned that this could constitute a criminal act.

“Repeated distribution of confidential information continued even after the Gucati was served on a court order regarding previous findings, which specifically ordered him to refrain from distributing those materials, and warned him that he could cause criminal criminal offence”, the prosecution's other reasoning said.

The prosecution further says that Gucati was not convinced even after the release of two court orders, and that on September 22nd he had said he would publish other information if he received, always according to the prosecution: also encouraging the media to do so.

Indeed, following the release of two court orders regarding previous findings, on September 22, 2020, Mr. GUCATI publicly declared: We told [...] special court investigators that we will publish all the documents we get if they are unable to prevent [their] flow. We want to tell the truth to the citizens of Kosovo that this court is trying with all means of '%sburn The KLA, but they will not succeed. It's useless with all the fakes they've made. He then encouraged the media to publish confidential information, declaring, "You have the material before you, just as you made public the names of false veterans, take the same courage”, reportedly in the prosecution's reasoning that Gucati remain in custody.

The Special Prosecutor in his reasoning says further that even Gucati's willingness to hand over the passport does not work. According to them, this is related only to the risk of flying to another country, not to other potential movements.

This does not address the fact that the trip from Kosovo is legally and illegally possible even without a passport, including states that have no obligation to transfer Gucati to the Prosecutor's Specialised Offices. Furthermore, the amount of money proposed as protection guarantees is insufficient to address the concrete dangers of release, especially in view of the permission Gucati has in OVL KLA sources, which is supposed to have up to 40 thousand members, it says.

Furthermore, the Special has also rejected evidence offered on the state of Gucati's health.

Mr. Gucati's health issues are universal, according to article 41”, said at the end of the prosecution's reasoning.

In this form, the Special has demanded that Gucati be kept in custody and procedures continue in the form as predicted.

Otherwise, the prosecutor in Gucati's case, Valeria Bolic, has said that within 30 days she will hand over the indictment against Haradinaj and Gucat for criminal acts they are charged with.

The two leaders of OVL KLA are charged with acts related to obstructing justice administration, with issues relating to publishing files that were stemming from the Special.
