Judgment against indictees in the case known as “Diploma”

On the other hand, Razim Berisha, Mehdi Joshi and Fatime Sabedini are accused of taking different actions in counterfeiting diplomas, reports “Justice Vow”.

Because of failing to hold this judicial review, it has been the absence of the accused Sabedini, for whom, the court judge, Sahit Krasniqi, said the same is found in Turkey, and that he has not been able to ensure its presence.

In this regard, Judge Krasniqi said the conditions for maintaining this judicial review have not been met, so he decided that the initial hearing for Thursday will be postponed indefinitely.

Otherwise, the initial hearings for April 25 and June 6, 2019, have failed to be held in the absence of defenders and some accused.

According to the indictment, Maxhun Maloku is accused of being an official person at the Directorate for Migration and Foreign October 9th and October 30th, November 12th and November 17th 2014, as well as on February 20, 2015, in Ferizaj, without authorization had provided official information via the defendants, Enver France, that it was scheduled for the search of the restaurants of the night, and that he had informed other indictees Razim Berisha and Rem Biszimni, who had removed girls from the restaurant who had no permission of work and residence in the Republic of Kosovo.

By what, he is accused of committing such acts, revealing official secrecy, and misusing official position or official authority.

Maloku is also accused of committing criminal acts, of exercising influence, because according to the indictment, on November 12, 2014, with the intention of exercising improper influence in decisionmaking, he had demanded that the other accused Fadil Rexhepi not be punished and expelled from the territory of Kosovo, citizens of the Republic of Albania, who had been banned from the police and confiscated of identification documents while returning from the restaurant <x0Interational Italy”, which he managed by the management of the Rezimsimi.

The other indictee in this case, Fadil Rexhepi, is charged with also that as an official person at the Directorate for Migration and Foreign Affairs on November 12, 2014, he misused the official task, since, in the case of the ban on girls from Albania who worked without work permits and without permission, had not pronounced fines and the extent of expulsion from the territory of the Republic of Kosovo.

The same is accused by the prosecution of committing criminal acts, revealing official secrecy because on December 24, 2014, as an official person without authorization had provided official information to the other person.

And, Enver France, accused of being a member of the KSF, having carried out the criminal exercise of influence, as from November 8th to December 18, 2014, at the Ferizaj doctrine and training centre, it has asked for a monetary reward, to exert influence on members of the Commission for physical testing of KSF candidates, in the way it had received 200 euros from its bank, Osman Magerra, to assist Nehat and Red Zyhra to pass the physical test to FSKSK.

He is also accused of two other criminal acts, ownership, control, or unauthorized possession of weapons, and assistance in committing criminal acts, evasion of taxes.

Meanwhile, Remzi Bislimi, as restaurant manager “International Italy”, in the village of Prelez of Jerlive, Ferizaj municipality, is accused that between November 8th and November 12, 2014, he had promised reward to accused Maxhun Maloku, to exert influence the other official person in the Directorate for Migration and Foreign Affairs, Fadil Rexhepi, not to be expelled from Albania. For this, it is accused of committing criminal work “impact management”.

At the same time, Bislimi is also accused of criminal activity “smangie of taxing”.

In addition, according to the indictment, Razim Berisha, as a member of the KSF, is charged with criminal acts “impact enforcement”, by Article 431 par.1 of the CRPK, the ongoing exercise of influence, for failing to inform criminal acts or their perpetrators of Article 386 par.1 below 1.9. and the “binding of the perpetrators after carrying out the criminal act”, by Article 388 par.1 and par.2 subpar.2.9 of KPRK.

Indictee Mehdi Joschi is charged with taking bribes and for falsification of official documents, since as secretary to the Gimnazin “Gjergj Kastrioiti-Skenderbeu” in Drenas, he had accepted in advance of 200 euros from the Elshani beat to issue official fake documents in the name of Fatime Morina.

And Fatime Sabedini is accused of enrolling in the “Fama” College, between 25 November 30th 2014, having handed in forged documents as having been conducted in the Gjimnazin High School, “Geng Kastrioti-Skenderbeu” in Drenas. What he's accused of committing a false criminal record by Article 398 par.2 of KPRK.

Charged for the exercise, there had been Isaac Smajli, secretary of the Professional Middle School “Fehmi Ladrovci”, in Drenas, but the same session at November 1, 2018, had pleaded guilty to the criminal work he was being charged with, and the procedure was set aside for him.

So Smajli, on November 14, 2018, the court had pronounced prison sentences of four months in prison, but prison sentences, with the consent of the accused, had been fined in the amount of 1500 euros.

Smajli was accused of having accepted the offer from Enver France in the amount of 800 euros to influence officials at the school's directorate to issue a forged degree as evidence of advanced performance in the Kosovo Security Force (FSK).

The accused also was Gymnasian professor “Gjergj Kastriot-Skenderbeu” in Drenas, the Elshani Beater, who on March 21, 2019, was sentenced to two years in prison on bail, having previously pleaded guilty to three criminal acts of influence, counterfeiting official documents and bribery.

He had pleaded guilty to the session, which was held on March 19, 2019.

For the first work, the exercise of influence, he has been sentenced to one year in prison, for counterfeiting official documents has been sentenced to nine months in prison, while for the third work, the penalty for bribery is six months in prison.

However, the chairman of the court, Musa Kondzhel, has said that conform Article 80 of KPRK, the court for all these criminal acts pronounces its unique sentence, in terms of two years of imprisonment, which his sentence will not be executed if in a two-year verifiable period he does not commit any other criminal act of this nature.

Elshani was charged that during 2015, as Djimnazi professor “Gjergje Kastriot-Skenderbeu”, in Drenas, he had accepted the offer for wealth gain, so that following his conversation with defendant Enver France, he had accepted the offer in the amount of 800 euros to influence officials of the directorate of the professional high school “Fehmi Lladrovcix <3>, in Drerna, to submit a forged degree in France.

He was also accused of marking false data in the name of Fatime Morina, as if she had been enrolled in high school, mathematical-natural direction.
