According to the Constitution, the Republic of Kosovo is an independent, sovereign, democratic, unique and inseparable state, linking international agreements and membership in international organisations, and participates in international co-operation for promoting and protecting peace, security and human rights.
The Republic of Kosovo recognises its obligations stemming from CEFTA and has consistently implemented all the obligations that flow. The Republic of Kosovo has always considered CEFTA the basis for establishing a free market economy based on international standards and principles of free trade.
While fully implementing its obligations, Kosovo has repeatedly reported failures from the Republic of Serbia to abide by their obligations stemming from CEFTA. Serbia has committed acts that violate CEFTA's obligations, interfered with domestic constitutional order and threatened Kosovo's sovereignty, security.
Following the 2008 Declaration of Independence, Kosovo businesses suffered major difficulties in exporting products to Serbia. Kosovo exporters are obliged to find alternative ways of access to the market resulting at additional costs of travel, logistics and administration. Kosovo's government and Kosovo individual businesses regularly reported violations from Serbia, including non-accepting Kosovo customs stamps, arbitrary customs stops, technical barriers and unnecessary procedures, and other non-Fiscal measures. These complaints have been recorded in the CEFTA database and sent to various CEFTA bodies, including the Joint Committee for Consultation and Sub-Commit for Barries No Tarifor. These complaints have also been handed over to Serbia's authorities. No consultation or resolution was implemented: Serbia has never successfully addressed these issues. In rare cases when complaints were addressed, the same obstacles returned constantly.
The continued and systematic acts of aggression by Serbia, violations of CEFTA's obligations, and interference in Kosovo's constitutional integrity have forced us as the Government of Kosovo to make decisions based on Article 17 (general exceptions) and Article 18 (safe security representatives) of CEFTA for compensation. Article 17 provides an overall right to limit imports due to public policy and public safety. Article 18 gives a state the specific right to “take any measures [...] to protect its essential security interests [...] at the time of [...] serious international tension that poses a threat to war. ”
Serbia has consistently engaged in acts that create international tension, pose war threats and a threat to public security. Serbia threatens to deploy its army in Kosovo, intervenes in Kosovo's internal affairs through support of illegal structures and criminal groups, and provokes interethnic tensions with a variety of means, including its support for convicted war criminals.
Because of Kosovo's continued violations of CEFTA from Serbia, threats to national security, intervention in domestic constitutional order, minimation of Kosovo's legitimate and legitimate aspirations for membership in international organisations, Kosovo affirms the invulnerability of the Constitution, which stipulates that the sovereignty and territorial integrity of the Republic of Kosovo is inexplicable, irrevocable, irrevocable and protected with all the means envisioned in the constitutions and law. Kosovo's government, in implementation of Article 92 (4) and 93 (4) of the Constitution of the Republic of Kosovo, on November 21st 2018 adopted a decision that, in addition, stipulates a 100% tax on imported products of origin in Serbia, and a ban on importing products containing descriptions such as Kosovo and Metohija.
