6m euros for 6 October is the amount the Central Election Commission needs. However, these vehicles are not yet received by the Ministry of Finance, as they are awaiting the Constitutional Court's decision regarding the clarification request former Prime Minister Ramush Haradinaj has called for the competencies of his resigned government.
CEC Chairman Valdete Daka said yesterday that in the event of the payment delay they need for election organisation, this institution does not take any responsibility.
“The CEC cannot take a step without having the money fixed. The CEC cannot take responsibility for delays, for failing to end elections. Because we from the first day and from the moment the prime minister resigned, have shown that since (2019) it was not an election year, the CEC has no means for organising the” elections, Daka said in a statement to the REL.
Periscope has asked law enforcement connoisseur Mazum Baraliu what happens if the 6 million euros needed for elections are not approved for the CEC.
The Ministry of Finance since the first meeting claimed by former Prime Minister Haradinaj to continue, the Ministry of Finance said that there is a problem with the decision-making, and in fact it has not been right and that meeting has been interrupted due to disagreements in the cabinet. They would have to find a follow-up technical element to make this payment. If these find mechanisms, legal obligations from provisions of legislation in force since they do not have law for the government then even the Constitution is not destrusive in this respect. The initiative of the former right constitutional prime minister has no basis in the constitution, I think this Constitutional Court will view as unacceptable this request of Haradinaj”, Baraliu has said. Periscope.
The outgoing minister also told the REL yesterday that all the money needed for election organisation exists, but cannot be carried without legal clarification.
I believe the Constitution should take action on its competence. Without issues, duties and competencies of the Constitutional Court being issued, we will expect to clarify this situation and, after clarifying the situation, take the necessary actions in line with law”, Hamza has said.
Meanwhile, the Council for Protection of Human Rights has also called for early elections in Kosovo to be held at the deadline set on October 6th, in order to speed up the formation of new institutions, while warning that any eventual postponements of them would severely damage the process.
The KMDLNJ considers that the Constitution should address the prime minister's request in high priority resignations as if even the CEC should show more flexibility for the fact that the means for elections are split and that their transfer could be delayed for several days and no longer.
If the Constitutional Court is delayed with an answer, if the CEC does not have the will to organise elections “wine” and if the Ministry of Finance is determined that “respect the law by not sharing the commands”, then according to KMDLNJ, postponing the term for holding elections is inevitable and “so this is a political goal that should be prevented at any cost<5>.
No state or country normal risks functioning of the state or country by turning away from the responsibilities they face so long ago that forming the new government in Kosovo could last 6 -8 months. In other countries we have similar situations, but there is no danger in functioning the state and there is no difference in quality of services between the government before resignation or dismissal, and after these processes have occurred. In this context, even this retired government must function until the new government is formed, with all the competencies and responsibilities that it has”, the KMDLNJ's response concludes./Periscopi/
