Judges ruled just a week after the United States revoted The Hague prosecutor Fatou Bensouda's visa. The revocation came just after its request, that The Hague tribunal investigate possible war crimes carried out by American forces in Afghanistan.

In the detailed explanation of the unanimous decision, judges of the three-member Prejudgment Chamber in The Hague wrote that such an investigation “would not serve the interest of justice”.
