Over 80% of the lawsuits are filed in court by women, and for the most part the main cause of divorce is violence. Children are victims of parental conflicts during and after this process.
Psychologists and representatives of state institutions worry that mothers mostly face a fatherly pension default, while the latter face obstacles in their meetings with children.
Under these conditions, the parties resorted to completion by bringing doubles in the finality of practices compared to 5 years ago.
In Albania legal and social affairs experts note that the Albanian family has been in crisis for nearly two decades. They support this conclusion to almost double the number of divorces compared with the late 1990s to 4500 in 2017.
In contrast, about 20 percent of marriages end in divorce. This is a lower figure than in Western countries, but in Albania divorce carries another weight because its consequences are heavier because of economic and social conditions.
About 85% of the number of requests for marriage solutions in court are recorded by women. Violence also accounts for over 80 times the main cause, to continue dependent on partners' drugs, gambling, treason, mental and physical disabilities, fraud, or differences in priorities and thinking.
The situation is very aggravated as they come to the court doors. A lot of women come by a defense order. Someone comes from legal medicine, someone comes from an extremely conflicted situation”, says lawyer Denise Daka.
During the process of resolving marriage and then, those who suffer most of the consequences of all conflicts are children.
Many women and men view children as aspirin to save their marriage, but that doesn't work. Trauma after the divorce of children, it's significant”, says lawyer Denise Daka.
The children present problems with their self-esteem, charged emotional state, sometimes become and aggressive because the first year of separation is always problematic for children, since it changes their whole way of life”, says psychologist Grita Talo.
But children after the divorce return to a battlefield between parents. According to statistics most mothers face problems of father's food pension.
Food retirement issues have almost doubled compared to 5 years ago, reaching approximately 6500 for 2018. Most of the court's decisions are passed for binding execution. Masters say they face mass efforts by the debit side, mainly to hide their wealth.
The opposition facing the most execution is linked to the fact that the debtor has no wealth, we talk about lack of legitimate wealth. We have the next situation that the debtor prevents execution, so the debtor hides his property from changing it. The reason for the non-execution of titles is informality in the employment sector”, says Etleva Zeqiray.
“The association for civic legal initiatives has made a survey of court decisions on this. In the case that the parent doesn't have the declared salary, but has declared it to minimum wage, and the court will therefore decide whether it's unemployed or is an immigrant, has divorced and escaped, and you have no available income at all. This is a problem that often leads to what is free of charge for children, food duties, and is forced by mothers to deal with all expenses”, says Etleva Sheshi, expert at the Ministry of Health and Social Affairs.
But we also have very serious cases when statesmen and governments have refused to lend retirement to children, or business-field people who have hidden their assets to reach a drastic decision, and secure a low quota of food pension in favor of children”, says lawyer Denise Daka.
In child dating issues, fathers are mostly the affected side compared to that of food pension, where those in the majority are debtors. The practice of dating children has doubled by five years ago to reach nearly 1100 in 2018. Defending the child's highest interest in the master is the hardest thing.
“Debit parties have often learned a trick, teaching the child to cry as he approaches the other parent. Here we are facing two dilemmas of saving the highest interest, that of the child. Thus, the judicial registrar is indeed the legal authority for execution, but he cannot bring the child closer through influence. In this case comes psychologist”, says Master Etleva Zeqiray.
Many women are attracted by divorce for economic reasons, but even those who manage to resolve marriage also face many challenges.
Those women who survive at serious conflicts, in families where violence is generated all the time, have extremely serious problems after divorce. In addition to being prejudiced by the environment, society and family are often left without a job and without a home”, says lawyer Denise Daka.
Authorities say that, in favour of women after the divorce, economic aid, social residence and lease bonus for women violated by protective order and family wives.
The relevant employment office pays employers who employ 11.5% of the minimum wage for a period when the contract is bound, not under a year. Another part that the employment office pays employers who hire women of the type of license we're talking about, paying 100% the measure of health and social insurance”, explains Etleva Sheshi, expert at the Ministry of Health and Social Affairs.
Against government measures, divorce essentially remains an extremely difficult process. In Albania, since 90, they have joined marriage under oath “until death divides us” about 677 thousand pairs and over 80 thousand or 12 %s have broken this oath.
