A Kosovo citizen had accused her former husband and his parents of keeping her violent closed in the joint residence. During the summer, Zug's (Cantonal) Supreme Court has handled this case, and the court ruling shows that the problem was not entirely as the victim has presented it, writes the zentralplus.ch, described albinfo.ch.
In the process carried out in advance at the Zug Criminal Court a year ago, the private plaintiff had left nothing wrong without saying his mother-in-law, broadcasts albinfo.ch. According to her, the 61-year-old woman who was her husband's mother was the world's worst “wife. She accused her mother - in - law that over a period of about two years, she had kept her confined regularly to the common residence.
The 61-year-old woman has been sentenced by the court in question to 15 months in prison on bail for forced and multiple deprivation of literature. She had also received a parole sentence with money.
Besides her mother-in-law (63) and former husband (42) have been charged. They all lived in a common apartment and had made sure that the victim's wife could not enter and leave the house when she wanted to.
The court has pronounced the father-in-law a bail sentence and a fine against him and his son was found to be even a violation of the gunkeeping law after having had a broken knife. In addition, the former husband had repeatedly threatened the victim with death, broadcasting albinfo.ch. They've been out of touch for some time now.
Compared with being confined to the apartment, the chief accused (the wife) said that in April 2016 he had brought her to the apartment because after a quarrel with her, she had fled the stairs and sought help. After he had thrown it into the apartment, he had beat it by hand and slamming it into the closet and then on the floor. Because of this violence, she had suffered bruises in her body that had been witnessed.
However, the three accused had rejected the act of judgment. Following the process conducted in July of this year, the case had to be tried by the Supreme Court. This court has only partially approved the preliminary court degree.
In addition, the Supreme Court expresses its doubts that the victim had really had no chance to leave the apartment, as the criminal court had arranged, broadcasts albinfo.ch. The victim's statements had not really been reliable. On the one hand, her claims about how often she was confined were not concrete enough.
On the other hand, questions arise about how it is possible that faithful people of the victim would not know about the extent of such intense drinking. What remains reliable is the charge of the case mentioned in her violent return to the apartment by the former husband. At this point, the Supreme Court has followed the argument of the preliminary degree of trial.
Thus, under the Supreme Court's ruling, the former husband is tried on bail, or 90 daily units from 90 francs, as well as a 300 franc fine. In addition, he must pay 500 francs as compensation to the victim. The amount goes to a child protection foundation in Switzerland. He was acquitted only of the prosecution's charge of assistance offered in the multiple deprivation of freedom, records albinfo.ch. This, for the fact that according to the court, there is not sufficient evidence that it deliberately and criminally closed by her mother-in-law.
Likewise, there is no evidence that the chief accused deliberately committed nothing against it (the wife's violent closure). For this reason, mother-in-law has been acquitted of multiple deprivation of her cloud freedom. While at the point of the charge of austerity, it is sentenced to parole sentences of 35 daily units of 30 francs. The same delta is sentenced to the same father-in-law, but the one with a bail sentence of 35 daily units from 90 francs.
The three accused are eligible for complaint at the Swiss Federal Court.
