IKD reacts to chief prosecutor appointment process

Kosovo's Institute for Justice (IKD) reacts to the Kosovo Prosecutorial Council (KPK) for the controversial integrity of the process of appointing prosecutors to Kosovo Special Prosecutor and the Constitutional Prosecutor in Pristina. According to the IKD, the process of appointing chief prosecutors does not meet the standards required to ensure a process of established appointment [...]
According to the IKD, the process of appointing chief prosecutors does not meet the required standards to ensure a process of appointment based on meritocracy, publicity, respect for the independent procedure of complaints affecting the public's lack of confidence in a fair, independent and impartial process.
“The P Prosecutors Name Process The SRK and PTh in Pristina has been characterised with the lack of proper publicity and transparency for the public. The KKP's hearings regarding objections put forward by candidates for the chief prosecutor of the two prosecutors have closed to the public, while the KKP has given no written explanation or reasoning. Unfortunately, both the appreciative panel and the Commission for Review have failed to bring their duties and responsibilities into line with the spirit and purpose of the Order. Moreover, as a result of the failure to understand the regulation adopted by the same KKP members, candidates for the chief prosecutor have passed through the process of evaluation and positioning twice before the Vulnerative Panel, on the basis of objections submitted by candidates. On the basis of regulation, the attitude and evaluation of candidates would have to be well justified and based, which in practice did not happen”, the communique said.
The IKD requires that all legal means by the parties be exploited in this process to follow legal ways to reverse the possibility of developing a process of integrity for electing prosecutors to Kosovo Special Prosecutor and the Constitutional Prosecutor in Pristina.
