Year's grave murder for property motives, accused plead innocent

In this case, on Tuesday, initial hearings were held at the Foundation Court in Gjilan.

They are charged that in May of this year, in the village of Sodovian of the Church of the Year's Community, deliberately, in co-ordination, for property motives, they have been deprived of life now to the late Muhamet Ismajli.

After reading the indictment by prosecutor Arben Kadriu, the accused have denied the guilt they are charged with, reports the “JusticeBetim”.

Otherwise, defenders of the accused, lawyers Ymer Huruglica, Skender Musa, Ilmi Dalippi, Shemsedin Piraj and Elvira Haziri have proposed to the court that against their accused of grave murder, stop the detention measure, which, according to them, have already ceased the reasons for continuing the move.

Even the defender of accused Edmon Ismajli, lawyer Sadbere Maliqi, has demanded from the tribunal that his defense cease the move to appear at the police station.

To these proposals, prosecutor Kadriu has reacted, who has demanded from the court that they not approve, who according to him, the accused live in the same village, and that criminal acts can be repeated.

Judge Zyhdi Haziri has stated that regarding these proposals, I will decide outside the court hearing.

Judge Haziri has announced to the accused, along with their defenders, that they have the right to reject the indictment, the evidence in the indictment, and its legality until January 17th 2020.

The founding prosecutor in Gjilan, on November 16, 2019, has filed charges against the accused, Besir, Samet, noble, Ismet and Izri Ismajli, with the reasoning that they on May 2, 2019, around 9:30, in the village of Sodovina of the Year's Commission, deliberately, in co-ordination, for property enrichment, have now deprived the lives of the late Muhamajli.

According to the indictment, the accused go to work on the controversial property, which is located near the home of the deceased now, and the deceased with his family come out to negotiate an agreement, where then the accused refuse and continue with insults by disposing of the situation in physical conflict, and the accused by strong means, such as wood and metal bars, now beat the deceased in different parts of the body, then the family members are transported to the House of Health in the Year, then as an emergency sent to the Emergency Center of National Hospital, and from there to QUKUK, where doctors are discovered in the Law Department of Medicine.

All the while, according to the indictment, the death of the deceased is said to be a violent death resulting from and as a result of massive blood on the head as a result of the bone fracture of the skull, where all of these have faithfully been caused by the mechanical operation of the sharp instrument.

The indictment states that accused Besmir Isjamli after he is already hit by the late Muhamel, by the crowd caused severe bodily injury, and the accused also inflicts body injuries on Kimete Ismajli, Edmond Ismajli, Armen Ismajli and Ridvan Ismajli, who, according to forensics, are part of minor bodily injuries with temporary health consequences.

With this, Besir, Samet, noble, Ismet and Izri Ismajli are accused that, in co-ordination, the serious “murder “, by Article 173 paragraph 1 subparagraph 1.6 related to Article 31 of the Republic of Kosovo Penal Code (KPRK).

On the second device of the indictment, accused Edmon Ismajli, by date, time and place as in the first device, due to a dispute over a property dispute, with the inevitability of violence, has deliberately caused physical injury to Ismaili and Ismajli.

According to the indictment, during encounters with labor tools, shovels, hits the accused, and causes slight bodily damage, with temporary health consequences.

With this, Edmond Ismajli is accused of committing criminal work “light body loss”, from Article 185 paragraph 2 over paragraph 1 subparography 1.4 of the Republic of Kosovo Penal Code (KPRK). /Betimy for Justice
