Judge Michael Simon, who serves as district judge in Oregon, ruled for a temporary ban on this proposal. The decision was made after seven American citizens and a nongovernmental organisation had filed complaints against this rule.
According to them, the new rule would block thousands of legal immigrants and that the number of immigrants entering the United States through family - sponsored visas would be greatly reduced or completely eliminated.
The court ruling states: “Facing the possible risk of separation from family members and delay in obtaining a visa, which in other cases would be donated to family members, is irreparably damaging”.
Judge Simon's decision to suspend this rule for 28 days implies that he will not start applying on November 3rd, but the legal battle on this issue is expected to continue longer.
