Hague investigates Kosovo Government Office . . this latter disputes procedure

The Kosovo Specialised Prosecutor's Office in The Hague is making investigations into the role of the Kosovo Government Office (in the Ministry of Justice) for the legal protection of potential indictees near specialised rooms, as well as the director of this office, Driton Lajci, for possible obstruction of justice, including claims on [...]
This is part of a document dealing with Lajci's lawyer's request to assess the constitutionality of the interview process.
Lajci has been questioned in The Hague on 17 October, quietly defending himself, while his lawyer, Toby Cadman, has confirmed to Radio Free Europe near Specialized RoomKosovo's Constitutional Court in The Hague has submitted a request concerning the constitutionality of the procedure during the interview, which is also part of the public documentation.
However, at this moment, he has not been able to speak any more about the content of that request or any other aspect of the case, “considered that this is a matter of ésub juridice”, or, a case that is in court.
Radio Free Europe has had access to public demand, which for several hours has been published on the Specialised Chamber website, but has since left.
As Free Europe has stated to Radio, specialised chamber spokeswoman Angela Greep, the request could be withdrawn from the website in case there is concern for parties, and then, after review by the competent Chamber, it could be published again or classified as confidential.

However, the request states that Lajci, although insistent, has not been informed in advance of what specific criminal acts are involved, on the basis of evidence for doubt that he committed criminal acts, while no specific claims have been reported either during the interview. For this reason, his lawyer, Cadman, has requested a review of the constitutionality of the interview procedure, saying it is a violation of the Constitution and The relevant laws.
Cadman, in his request, also insists on establishing the practice, which will enable all future interviews “to comply with law” and that Lajci's interview, on October 17th, be considered illegal and unacceptable.
The Specialised Chamber of the Kosovo Constitution in The Hague is the latest insistence on the interpretation of the Constitution on issues dealing with the work of Specialised Chambers and Specialised Prosecutors. Cadman, in the name of Lajci, has turned to the Specialised Chamber of the Constitution of Kosovo, calling on the article of the Constitution of Kosovo, which says that the <x0iddes can initiate procedure in case their rights and freedoms guaranteed by the Constitution are violated on the part of public organs, when all legal means are exhausted”.
He also considers that the procedures approved for the interview, in line with the invitation, are not in line with the Constitution of Kosovo, with the regulation of procedure and evidence of the Specialised Chambers, as well as with Kosovo's obligations and for the rooms to act in accordance with international human rights.
In Radio Free Europe questions, the Specialised Prosecutor has refused to give any comments.
Crime Against justice enforcement, of course, crimes committed during the trials, such as the destruction of evidence, intimidation of witnesses and others, are among the categories over which the Special Court has competence, including crimes against humanity, war crimes and other criminal acts according to Kosovo laws, and connected with claims in the Dick Marty Eurodeput report in 2011.
As stated in the submitted request by lawyer Cadman, the head of the Kosovo Government Office, Driton Lajci, at the end of September, had received an invitation for the October 17th to appear in The Hague to be interviewed in the quality of the suspect, in connection with the official criminal investigation from the Special Prosecutor's Office”, because “has the reason to believe he has participated in carrying out the criminal work under the competencies of the Kosovo Chambers Specialised<3>.
