Former Educators' indictment approved, Kosovo's Fusha Community is obliged to compensate after retirement wages

The Constitutional Court in Pristina has approved the application of former teacher Ibush Qyqalla, who has demanded from Kosovo's Fusa Community the compensation of three witness salaries and three Jubilare salaries, at a total of about two thousand euros. That amount, he has asked for the claim that under Kosovo's General Kolecative Agreement, after retirement according to legal power, it belongs to witness and jubilee salaries.
With the indictment of July 23, 2019, the court has approved the prosecution of the Qyqalla plain for compensation of three jubilee salaries and three witness salaries, in many of the 1,907.08 euros.
The court has also approved the cost of the procedure in many of the 270.00 euros.
The court has based this ruling on the Kosovo General Kolecative Agreement, at Article 52, respectively, where the worker's right to legal reward is provided, as well as on Article 53, where the primary pension payment right is.
Otherwise, regarding this case, at the session, held on July 9, 2019, was the final word by the interjugal parties.
In the final address, the plaintiff's representative, lawyer Fatbad Makolli, had demanded from the court that the indictment be approved as a base, as well as owed the indictee, that the plaintiffs would compensate for three handouts and three jubilee salaries, in many of 1,907.8 euros.
Also, the plaintiff's representative has asked the procedure's spending and the one for the 104-euro indictment, for representation at a 135-euro session and for a 40-euro court tax.
Kosovo's Fushe municipality representative Hasime Qyqalla, in her final address had stated that she stands close to the answer in the indictment, adding that under the sectoral contract, only a jubilee salary should be compensated, rather than three salaries, as the plaintiff demanded.
She had demanded from the court that the plaintiff's indictment be rejected as unfounded, with the argument that Kosovo's Fushe municipality does not share means for payment of jubilee and watch pay.
In view of this opposition, she had declared that Kosovo's Fushe Community has no agreement with the Ministry of Finance on this compensation.
In contrast, according to the indictment exercised on August 10th 2018, plaintiff Ibush Qyqalla has demanded from the Fusha Kosovo municipality, compensation of three jubilee salaries and three witness salaries, to a total of 1,907.8 euros, which he claims belong to according to legal provisions.
The indictment claims that the plaintiff had been in working relations as an educator at the “Zeynel Salihu”, in the Great Bedhe, Kosovo's Fusha municipality, until June 18th 2018. In the indictment, the plaintiff claims the indictee has failed to abide by the legal provisions in power in which the compensation of three jubilary salaries and three witness salaries is provided after reaching the work experience of 30 years, unbroken to the last employer.
Therefore, on the side of this indictment, the plaintiff Qyqalla has demanded that his indictment be approved as based and imposed on the compensation of jubilee wages and escorts to a total of 1.907.8 euros. /Betimy for Justice
