Kumanovo's Constitutional Court has called for February 19th the hearing for the retrial of the Almir Ali case. The trial chamber will be led by Judge Maja Denkoska, while the prosecution will be represented by the first prosecution prosecutor, Suazana Kusigerska. The Aliu family has welcomed this decision, but has voiced scepticism about the retrial process. Almir's father, Sedat Aliu, points out that the court does not require mercy, but only justice.
We've always asked only for justice and never asked for mercy from anyone. The Skopje Court of Appeals has seen the remarks and assessed the subject as reasonable because of the Kumanovo Court's concessions. From now on, we expect the same mistakes not to be made. From the Kumanovo Court, we ask for nothing but justice”, said Sedat Aliu, the father of Almir Ali.
The document that Alsat has secured, which concerns the Appeals Court's decision to restore the subject to retrial, refers primarily to the groundless requalification of the work from “to the” to “contacter”.
The trial will prove whether accused Boban Ilic has done the work deliberately or carelessly. Prove it if psychiatric experts who made the expertise have had currency licenses and, in line with the Law on Legal expertise”, say by the Court of Appeals in the Almir Ali case
Kumanovo's Constitutional Prosecutor's complaint to the low sentence for accused Boban Ilic has been dismissed as arguing that in the situation when the case turns into retrial, there is no substance and no work and therefore cannot be processed. For Almir Ali's murder, Boban Ilic was sentenced to 6 years in prison, while Almir's father, along with two family members, was sentenced to six months and one to nine months in effective prison.
Outside the indictment remained the brother of the first accuser, Bojan Ilic. The Constitutional Prosecutor, on the basis of neuropsychiatric expertise, requisified the charge of murder in traffic accidents, no matter how expertly prepared by experts without license. Almir's murder occurred on June 25, 2016, in Kumanovo. /Alsat/
