Special Prosecutor Merita Bina Rugova had remarks against witnesses who, according to her, are constantly changing their statements from the past.
While defender Marjan Kqira, Kosovo lawyer Kelmendi, repeatedly had remarks about the form of witnesses being questioned.
According to the lawyer, in this form there's pressure on the witness. She had remarks that she is not allowed to provide the answer the witness wants.
There was also a clash between the chairman of the court, Xhedin Osmani, and attorney Tome Gashi, who in the retrial is representing the damaged side in this process, Zef and Pal Gruda.
According to Judge Osmani lawyer Gashi is asking provocative questions to the witness.
Two of the about 13 witnesses proposed by special prosecutor Merita Bina Rugova were heard in the trial held today.
According to the prosecutor, witnesses have exchanged their statements from earlier statements to the Special Prosecution and the Police in front of investigative officials.
After witness Burim Shala, for whom there were not many questions from the parties, appeared witness Fadil Gashi, who several times during the time of giving his testimony stated he stood by the statements he had previously given and asked the court to be released from the hearing because he had nothing to add and had some family health problems.
The special prosecutor Merita Bina-Rugova witnessed questions, and throughout the course of the time confronted with conversations she had been conducting with the accused in the February period March 2015. According to the prosecutor, the witness was threatened and had continued pressure from the accused.
But the witness denied the prosecutor's claims that he was threatened.
According to him, the one with the accused who has long had social and friendly reports, so even in February, March 2015, the same had several meetings with some of the accused “but only for work and for trading of a building”.
The special prosecutor demanded from the court's chairman that the witness be convicted of constitutional law because the same was refusing to answer her questions.
When Judge Xhedinus Osmani warned the witness who is obliged to answer the prosecutor's questions, otherwise he would be condemned by the court to the legal provisions, then witness Fadil Gashi stressed there is nothing more to add than to earlier statements.
Objections and remarks included Kosovar lawyer Kelmendi, who said the form of the witness being questioned is unacceptable “since pressure is being put on witness”, though, according to her, he was stating that he is standing next to statements previously issued.
According to lawyer Kelmendi, the witness is being asked questions he is not obliged to answer.
And when attorney Tome Gashi got word, the same witness started asking questions about what education he had done and how old he was when he went to high school.
This irritated the witness, who refused to answer. The chairman of the court, Xhedin Osmani, who warned lawyer Gashi that he would not allow provocative questions about the witness and that information about the witness is in the subject's papers.
As lawyer Tome Gashi addressed the Ottoman judge with the words: “Listen, because don't threaten me, I'm not Arian Koci. Reject the question, but don't threaten me.
The court, consisting of judges Artan Sajran and Refki Piraj, warned the lawyer Gashi to pose questions only that had links with the injured, who he also represented.
As the witness completed his testimony, special prosecutor Merita Bina Rugova presented the same remarks, since according to her “it is evident that there was pressure on witness”.
Furthermore, since there were no other witnesses to continue, the review was interrupted and assigned two days during February, where other witnesses who were nominated by special prosecutor Merita Bina Rugova will be invited.
This case is a case targeted for visa liberalisation.
