The Swiss Federal Court has convicted a company manager after he in his company had illegally employed brother.
The event occurred in Badden County, Canton Aargau.
In this case it was interesting according to the court that he was never asked about changing citizenship from Kosovo to Slovenian.
However, authorities later discovered that his Slovenian documents had been forged.
The head of the company who had hired the brother was asked if in such a close family report he should have been interested in his brother's status, he answered briefly: no.
But the Federal Court did not trust him and therefore sentenced him on bail to a fine of 64 daily units out of 50 francs.
With that ruling, Switzerland's highest court has confirmed the decision of the Supreme Court of Aregau Canton and the district of Badden, against which the convicted had filed complaints.
According to the Federal Court, the employer had to know at least the fact that his brother has no Slovenian state affiliation.
The latter, on the other hand, thanks to the Slovenian passport (as an EU state) had won from the Cyril Migration Office the right to stay in Switzerland.
And, as it is known, such a stance enables citizens of EU countries the right to work in Switzerland
