Civil society reacts to Haradinaj's decision, calls it legal offence

Civil society has reacted to the government's decision to appoint MTI secretary general. The “already continuing the practice of violating the laws, the Haradinaj government at the meeting of January 29th 2018 has made a non-legal decision in the case of appointing the secretary-general in the Ministry of Trade and Industry (MTI). With the decision 1126, the government has named Burim Rhecaj of the MTI secretary general, even though he failed to meet the criteria for this high position in the civil service”, it is said that the Group for Jury and Political Studies signed the response, INDEP, GAP Institute, Kosovo Institute for Justice, Democracy Plus (D+), Get up, Initiative for Progress INPO, Kosovo Democratic Institute KDI, Columbus and D4D Institute.

These organisations, in the joint response, have written that for interviewing candidates for MTI secretary general, the assessment commission has also been supported by the British company, according to the Kosovo Government's signed memorandum with the British Embassy in Pristina (recognition recently signed between British Ambassador and Prime Minister Haradinaj on October 11th 2017).

“Based on the British company's assessment and the assessment commission, the only candidate to have met the criteria for appointing the secretary general was Gentiana Islamaj, who by the end of January 2018 was the applicant of the secretary general's office in the MTI. Burim Rrecaj, who was elected by the government as secretary-general, was ranked fourth with scores. He managed to be included on the list of three candidates MAP has sent to the government only after leaving the process inexplicably, one of the candidates” said in response.

The reaction further states that according to Article 15, paragraph 3, of the Law for Civil Service, The MAP sends the government the selection of one of the three best candidates on the basis of assessments by the assessment commission.

The “would be logical for the government to select the candidate/en who has received the largest number of scores, rather than selecting candidates who do not meet the criteria for that position”, it is said in response.

Moreover, Burim Rrecaj was part of the party's election list Initiative for Minister of the Municipal Assembly of Pristina. With this decision, the Government of Kosovo has violated the Law for Civil Service, politicised one of the highest positions in civil service, sacrificed professionalism and violated employment rights, and violated the memorandum of understanding with the British Embassy for recruiting professionals in high state positions. Cases like these send bad signals to all those professionals who want to contribute to the public sector”, it says in response.

With this letter, signatory organisations call on the government to annul the 1126 decision to appoint the secretary-general to the MTI, while also calling for the intervention of the Independent Council of Kosovo Civil Service overseer.
