KKP decision Canceled Art Moion wins match transmission right

As Art Moion reports, after the review, the legal rating body deemed the complaint exercised by Art Motion as fair, while the KPM ruling described it as not based on laws and regulations in power.

Justice wins, KPM and UEFA reconfirm Art Motion's right to broadcast matches the Independent Media Commission Board (KPM) has cancelled this agency's recent decision on Art Motion, with which it was required to cut off transmission of Arena Sports programmes, allowing the Kosovo platform to continue broadcasting without restrictions.

After the review, the legal rating body deemed the complaint exercised by Art Moion as fair, while the KPM's decision described it as unfounded in the laws and regulations in force. This board even appreciated that the decision The KKPM, which requires Art Motion to interrupt broadcasting and programmes of the Arena Sport for Kosovo, conflicts with the legality of the decision. “Bord states that the complaint party's claims (Art Motion) regarding the actual state and legal violations are based because the Independent Commission of the Medes, in the case of making the controversial decision, has not fully proved the situation, as well as not applying it to the material law and procedure”, is said in the letter of the KPM Ankes Board.

In addition to the Board's decision to complain to KPM, which states the Independent Media Commission has acted contrary to the laws in force, the situation now clears up U. W. EFA. This institution calls the purchase of programmes by Arena Sports fully fair, featuring the Champions League and the League of Europe, and confirms Art Moion's right to show their matches in Kosovo.

And also, UEFA rejects the main claim of Kosovo's Parliamentary Commission for Media of the Assembly and the Independent Commission of the Media, where it claimed that with the broadcast of the Arena Sport capitalised on Kosovo's sovereignty and territorial integrity, clarifying that with the transmission of the League of Champions and League of Europe through the Arena Sports package, no violation of sovereignty is implied.

“Initially, we want to confirm that UEFA respects the sovereignty of the Republic of Kosovo. As you know, the Kosovo Football Federation has been accepted as a member of U EFA in May 2016. This has been one of the main reasons to lead separate processes for media broadcasting rights for the U Champions League EFA on Kosovo territory for the first time”, said in UEFA's letter run KAM's. According to UEFA, during consultations on the sale of rights in Kosovo, it is considered that broadcasting the League of Champions in Serbian is of secondary importance, as initially no company in Kosovo had expressed interest in buying these rights. In the letter, it also stresses that Kosovo companies, who have been competing for the purchase of the Champions League's primary rights, have been notified on this issue. “In the continuation of meetings for the sale of rights for the transmission of the Champions League and Evil Europe in Pristina, between 13-15 February 2018, T EAM has announced possible bidders for granting unexcusive rights in the Serbian language”, explained in UEFA response.

This response by UEFA has been sent to KPM Chairman Mujo Ferati, who had made a decision to cut off the transmission of Arena Sports in Kosovo at the request of Media Commission Chairman Nat Hasani.

Art Motion estimates that although with the decision of the KPM Anques Board and the U letter EFA's justice has been put in place, however, the noise artificially created about this process, whose end has been known since the beginning, has been aimed at damaging the company.

Platforms offering similar services in Kosovo, the ruling that is already invalid of the KPM and the parliamentary Commission's illegal request had made efforts to tarnish Art Moion.

With an unfairly damaged reputation, Art Motion is determined to exercise every legal means available, ranging from criminal charges, civil indictments to international arbitration, in order to protect the guaranteed right to the Constitution, as well as international legislation, for the development of legitimate business activities.

To prevent the violation of this right, which also guarantees the Constitution of the Republic of Kosovo, Art Motion has already committed an American law firm to Washington DC in the US.

Meanwhile, even after this process, as during the time of the subject, Art Moion will continue to broadcast the Arena Sport channel on its television platform.

Transmission of the Champions League, the League of Europe, as well as many other events will continue to be broadcast in Art Motion for the next three years.

Artena Sport programmes are broadcast not only on the territory of the Republic of Kosovo, but also on Slovenia and Croatia (Strates of the European Union), Montenegro, Serbia, Bosnia and Macedonia.
