If Kosovo abolishes

The initiative of several Kosovo Assembly deputies for the abolition of the Special Court, and the support this initiative is receiving from state leaders, is unexplorable political adventure, with disastrous consequences for anything that could have been built in post-war Kosovo.

I want to say at the top of the row that this court is founded, not by the will or will of Kosovo institutions, or whatever political force, but is founded at the clear request of the international community, in the first order of the US and the EU. So this has resulted from our failure as a state in the field of justice, the failure of justice in Kosovo to face any claim and charge, by any side, for crimes committed in Kosovo, and as a consequence of our inability to ensure security for witnesses.

So, like the establishment, the abolition of this trial goes far beyond Kosovo's will, will and diplomatic power. This initiative is therefore arbitrary, politically irresponsible and destructive, and functionally highly harmful even to all those eventual defendants, who will only increase the situation.

Specialised rooms and the Prosecutor's Office, which we are already telling the Special Court, is a constitutional category, with the vote of 2/3 of Kosovo's deputies from the previous legislature. Although it goes beyond our preferences, this court is not an international court but is a Kosovo constitutional institution that recognises and respects Kosovo's constitutional and judicial order.

That is the main reason our strategic partners see this court as the international obligation Kosovo offers the possibility to prove publicly as a state where law and justice are respected.

The weakening of this court would therefore bring back to the game all the range of dangerous and old scenarios and alternatives for Kosovo.

We can't forget where we were...

Resolution 1244 is still in effect, though silent in almost every functional dimension in Kosovo. But initiatives like this for abolishing the court can greatly empower this resolution and therefore will empower those UN member states that strongly oppose Xova's independence.

So if Kosovo did not establish this court, through constitutional changes and approval of the law, the UN Security Council would do that on the basis of Resolution 1244.

All those who today with the greatest ferocity are putting mines in partnership with America and other Quinti countries know, and it was said to them, that if Kosovo does not take responsibility for establishing this Court and whiteling all allegations of crime, then the US will not prevent its establishment by the Security Council.

Could that happen now, if I myself abolish the law for the court. The answer is yes! YES GREE... and the establishment of this UN KS ruling court would strengthen the role of Russia and China, and therefore every camp in these countries, as well as Serbia itself against Kosovo independence, would be much more efficient.

So the abolition would result in the intervention of the UN Security Council, the repowering of Resolution 1244 and the increasing role of Russia in our country. At the same time, which is even more painful, would bring an isolation of Kosovo and abandonment from all those friendly countries that Kosovo made state.

So the initiative and effort to abolish the Court is a dangerous game, with devastating consequences for Kosovo today and tomorrow.

The court can't be broken.

Surprisingly and paradoxically, if we fail to prove that we want rule of law, this will be imposed by the Security Council. The UN, and I'm saying it out of fear, let's not be surprised that this initiative in the KS can come. Pardoxically, by the U.S. itself, always in order not to be left with diplomatic primatism Russia and China.
