Mr. Weiner, 53, immediately after announcing a judge's decision in Menheta, New York, has begun to cry, Reuters reports.
In May, he had pleaded guilty to transfer shameless messages to a minor and agreed not to complain if he was sentenced to 27 months in prison or less.
Mr. Weiner's lawyers have demanded that he be sentenced on parole, not jail.
Investigations concerning the exchange of messages to Mr. Weiner, with a North Carolina student, have affected the final days of the presidential campaign, when authorities found the emails on Weiner's computer.
His wife, Huma Abedin, was an associate of the democratic presidential candidate Hillary Clinton. Later Mrs. Abednego asked for a divorce.
