In fact, according to the prosecution, investments have reached only 542,243,56 euros “that has not met the amount of investments of 957.756.55 euros, a situation that has negatively affected the success of the subject”.
The prosecution claims Mustafa has also neglected to present annual reports about this partnership, and therefore “has caused damage to public partnership material, KR Higyna” respectively.
Also, according to the prosecution, he has not exploited the right under Article 16 of the partnership cuts due to violations of obligations from the other private partnership.
According to the prosecution, the agreement is signed based on a law that was abolished with the release of the new Public-privat Partnership Law, “that the agreement is in conflict with” with two provisions of this law “because the same law is signed without the preliminary assurance of consent by the Kosovo government”.
However, the indictment says Mustafa has denied any legal violations. In his statement given to the prosecutor, he has not rejected the fact that he has signed the agreement, but stresses that he has done so in accordance with the Law on Local Government.
