EULEX prosecutor seeks maximum sentence for Gani Gecin

The prosecution wants Geci tried for serious murder, not murder.

In the complaint filed at the Appeals Court, EULEX prosecutor Steluta Lily-Oprea is demanding that Gunny Geci be tried for serious murder, not murder.

Charged for the murder of Ruzhdi Shaqiri on August 4th 2014, Gaj Geci in June last year has been sentenced to 4 and a half years in prison.

In connection with this event, Geci was found guilty of the crime of murder, and sentenced to four years and six months in prison.

EULEX prosecutor Steluta Li-Oprea is countering the Mitrovica Foundation Court's decision, saying Geci's work should be named as a serious murder rather than murder.

“Procuroria claims that the way evidence and conclusions drawn on the facts and legal cases related to redefining the prosecution from heavy murder to murder is irrational, flawed and fallible”, the prosecution's complaint said.

Ganit Geci's mental state is rejected in the prosecution's complaint at the moment of committing criminal acts.

“The court's finding as described in the court's conviction that Gani Geci was proven to be in serious state of mental effect when he killed Ruzhdzi Shaqiri '%s is wrong, subjective and contrary to”, it is said in complaint.

Prosecutor Oprea further in her complaint contradicts the Court's reasoning, claiming she is not in line with expert findings.

The “is obviously fallible and beyond the court's powers to operate beyond the cases in its competence”, the complaint said.

In addition to expertise, the prosecution's complaint also disputes the tribunal's findings concerning witnesses.

None of the witnesses -- Idriz Morina, Nehat Shaqiri, Visar Behram and Halil Geci -- who were not eyewitnesses -- can prove to be a credible and verifiable independent threat to the defendant's life. So the Honored Court is obviously wrong when it states that it was found and testified that Gajni Geci himself was convinced that he for many years was in a life threat and that Ruzhdzi Shaqiri himself was involved as part of this”, the prosecution's complaint said.

Based on these alleged complaints, Prosecutor Oprea requires that the Court of Appeals carefully analyze the prosecution's complaint and Gani Gecin condemn it according to the laws of the serious murder.

Unlike the prosecution, Geci's attorney, Ndec Doda rejects the tribunal's findings and prosecution claims.

The Doda over the phone for KALLXO.com said defence from the beginning has been convinced that the work should qualify as necessary protection and in no way as murder.

“We from the beginning have demanded that the work be updated but in necessary defence. In the defence opinion, the court would have to defend it to the necessary extinguisher when it thinks it is being attacked and reacts to”, Doda said.

The Court of Appeals has yet to call the hearing to review the prosecution's complaints and attorney.
