The director of the Kosovo Institute for Protection of Monuments (IKMM) has reacted to the statement by Kosovo Culture, Youth and Sports Director in the Vushtrri Community, Hope Rama, who in a script published yesterday on her official page at “Facebook” entitled “Monument Protection Institute gives Vushtrri Castle into use without any warning”.
According to Gergur, the protected monument of cultural heritage known as “the Vushtrria Kalaja” is owned by the Kosovo Institute for Protection of Monuments, not the Vushtrri Community.
This response from Grogur came after the many reactions he had in the last two days to provide a portion of Kale for a restaurant.
And below, you have an IKM response to scriptures published in our media based on this statement by the director of the DKRS of the Vushtrri municipality, Mrs. Rama hope.
The Kosovo Institute for Protection of Monuments, which I lead, deeply expresses regret at the manner of unwise and wrong treatment and response that Mrs. Rama hope. I KMM, there has been, in effect, a very good co-operation with the Wushtrrit municipality and Mr. Mayor. Mukaku, on which, as rarely in Kosovo, we have found high support and readiness for co-operation in the function of preserving and protecting cultural heritage monuments found in the Vushtrri municipality. This makes this reaction so strange today, but perhaps the director may have reacted without Mr. Chairman's knowledge. Mullaku, otherwise, does not believe that such an unconventional, unassailed, and without any legal basis.
We call this statement completely wrong for the reasons:
The protected monument to the cultural heritage known as “The horse of the Vushtrria” is owned by the Kosovo Institute for Protection of Monuments, not the Vushtrria municipality.
Interventions at monuments submit to rules, criteria, technical and professional standards of conservation in case of interventions in these assets. All these are issues arranged with the provisions of Law No. 02/L 088 for Cultural Heritage. But according to the Law, every project on any level of intervention is originally sent to specialised institutions (which on the basis of legislation in force has this exclusive competence with which the IKMM is provided or not permission for intervention or professional remarks are made so that interventions are the same as to restore, improve and present the values of the monument/aset, respectively, such interventions will not harm, violate or otherwise affect the value of the monument.
The law also provides authorisations for institutions on who will make project assessments, who oversees them, who has the right to perform jobs in cultural heritage, in what criteria, conditions, etc. In the concrete case as an institution, we have acted in full accordance with the criteria and legal provisions of the legal regulatory framework of cultural heritage.
Initially, with the recommendation of the Professional Commission for the Review and Recognition of the Conservative-Reservative Project of Cultural Heritage, which operates within the IKM, has been reviewed, assessed and approved all interventions proposed with the Kale restoration project, which includes continued maintenance aimed at preventing degradation. Also, part of the project was the operating of a space for use in the field of gastronomy by the investor. There is also the relevant IKM decision for this project, as a competent institution, on the approval of the project in which the character and reasonableness of the interventions that have been proposed/projected. Based on the fact that the IKMM is also the owner of the monument, there is also the competent institution that makes assessments of interventions in cultural heritage assets, then that there is a legal mandate to make restoration and conservation, and to oversee other subjects exercising this activity, at the same time, is also the competent institution that, based on LTK, is entitled, based on Article 6 (paragraph 3) to authorise the use for economic and cultural benefit of the architectural heritage objects, what is the Wolary Castle of the Vatican. So such a right/authority to allow these activities in monuments is authorized by permission written by the competent institution, which in this case is IKMM.
The Vushtrri municipality has no right to ban or intervene in the competencies of institutions that have the mandate to defend and preserve the cultural heritage defined with the 02/L 02/L 088 for Cultural Heritage.
To us it's strange how Mrs. Rama's hope, although maintaining the position of Director for Culture, Youth and Sports in Vushtrri, now and as long, does not recognise the laws and norms on which the field of cultural heritage in the Republic of Kosovo functions, the more in one city/ Civilised municipalities in respect and recognition of cultural heritage value.
Finally, praising that the implementation of such a project would increase the continued care and maintenance of the monument, so it would stop the further degradation of the Kale object, (for the time it was under the care of the DKRS of Vushtrria, the object has been further degraded, see the attached photos, from the flagrant care it has demonstrated in the maintenance of the monument), the implementation of the project at the same time, would also increase visibility, so it would further promote this monument based on our competencies, we have acted on the basic Law. 02/L-088 for Cultural Heritage. All parameters of free access to visitors, available space to visit the monument are provided. It's true that Vushtrri Castle has become a restaurant.
