Until the Court of Appeals had rejected the defence complaint in the case of the attack on journalist Vehbi Kajtazi, leaving Fitim Thaci in custody, defence lawyer Gazmend Halilaj believes his client will be released in regular procedure after completing this 30-day detention measure.
He for the Blic newspaper has stressed that he is expecting his client to be released in regular procedure at this deadline.
The complaint has been reviewed, the Constitutional Court's decision has remained in effect, but now we are waiting for the 30-day deadline to be released in regular procedure because we have no knowledge the prosecutor will apply for the continuation of this measure.”, he said.
As for the possibility of continuing this provisional move by the Court, Halilaj quoted the Criminal Procedure Code, Article 1.1 points 2 respectively, in the event the sentence is continued 3 days earlier, proposals and objections were submitted then by the defence side.
” Based on Article 1.9.1 points of the Criminal Procedure Code 2, the prosecutor is obliged that if he makes a proposal to continue detention 3 days earlier to inform us before the deadline comes with proposals and we give him our proposals, our objections.”, added a
Lawyer Halilaj also added that there is no information as to whether the same measure of his client will be continued until it adds that it is unnecessary, unreasonable and not supported by law.
If the prosecutor makes the proposal then the hearing will be held, and the prosecutor and the defender will submit their proposals, the prosecutor supports the proposal he makes, the protector is opposed to it and presents the arguments which argue that the prosecutor's proposal is unreasonable, unreputed in legal terms, then left the court to decide on that matter.”, he concluded.
We remember that on October 13th, 27 days ago Fitim Thaci attacked journalist Vehbi Kaitazi in one of Pristina's coffees, writes Blic newspaper.
For Thaci, the Constitutional Court appointed the detention measure for the period of 1 month.
Following the case of the assault on Vehbi Kaitazi, several photos were circulated in the media linking Thaci with Kosovo Initiative MP Milaim Zeka, and instructed the attack on Kaitazi precisely because of the research publications he had done for MP Zeka.
That was rejected by Thaci, Zeka and their lawyer.
