The repentance of Kosovo's head of state for the establishment of the Special Court for War Crimes in Kosovo cannot produce any effect in reporting to the tribunal, but not any opinion response to this court, estimates connoisseurs of political developments and judicial aspects in Kosovo.
Kosovo President Hashim Thaci, on Monday, during the presentation of a public perception report about the Special Court, organised by several nongovernmental organisations in Pristina, has named the establishment of the Special Court, “unjust historical processes to Kosovo”. He has stressed that he has agreed to lead this process as compromise, with promises from international factors, visa liberalisation, the formation of the military, Kosovo's accession to international organisations, as well as increasing the number of recognitions from different countries.
Politologist Ramush Tahiri, speaking of Radio Free Europe, has stressed that President Thaci's reaction is due to disappointment with designated international factors that did not realise compromises, which local opinion did not have any real-time information. But, as Tahiri says, the state head's repentance over the Special Court case will have no impact on the job of the latter.
“This court cannot be aggrieved because it is not expected that the Parliament will reconsider and make another decision, although there were some attempts in the past, months ago in the Kosovo Assembly. This is just some kind of excuse, perhaps, that this court is working Hashim Thaci's office, now in the presidential post. But I don't think it will have any practical impact, except it will have an impact on Kosovo or its president's relations with the international factor”, Tahiri says.
But, constitutional court expert Mazlum Baraliu, professor at the University of Pristina, tells Radio Free Europe that it is completely insignificant whether Kosovo institutions' leaders have repented or not regarding the Special Court. According to him, President Thaci, who at the time of the launch of the process for establishing the Special Court was in the position of prime minister, had to make compromises public.
It's regret or not, it's unrealistic. As usual, our institutions' exhibitors have been in constant operation of the international community's demands. Meanwhile, what he is saying is that there has been a compromise, for that compromise we have not known. It has been necessary since then, they and this one, to insist that when such agreements are made, compromise has insurance mechanisms, that they be realised and that Kosovo will constantly lose”.
But can President Thaci's statements regarding the Special Court create effects on public opinion?
Politologist Tahiri expresses the opinion that this statement could promote the opinion, but the recent opinion and reaction of the opinion cannot influence the work of the Special Court.
“Opinion responses will be made, because nobody -- including the president himself -- is entitled to the investigation of this court and the fair and fair process that will be allowed, depending on the legal provisions that are envisioned by this law. However, this job does not help because opinion and the impact of opinion on judicial processes are independent of the court's work”.
Professor Baraliu does not expect reaction from the opinion, because according to him, the president's reaction is delayed.
“Perhaps it is a delayed response of the president himself, because then he has had to act and not allow such compromises to not be realized for the benefit of Kosovo, to benefit something Kosovo and not just lose, as is the case with the Special Court, which is indeed unfair”.
President Thaci, however, has declared that Special Court “will be only one point of justice”, as he has said, “in the sea of injustices that have occurred in Kosovo”. He has raised the question that “will reveal the truth and will bring interethnic reconciliation”, the Special Court, which is expected in a very near future to proceed with the first cases.
