Tahiri said the Brussels agreement has seen the functioning of courts in the north under Kosovo laws. A fact of that, he said, is the decree of 53 Serbian judges and prosecutors before President Hashim Thaci.
Tahiri said that today the extent of sovereignty in practical terms is taking place throughout the country. Asked by Commission Chairman Albulen Haxhiu if the agreement is constitutional, Minister Tahiri said this agreement is in full compliance with the Constitution.
Tahiri also stressed that no decision made by parallel structures will be recognised.
Mayor Haxhiu said they consider it incompatible with the Constitution, the justice agreement. According to this agreement are two justice systems. She said from the documents she has secured that Kosovo has agreed with this agreement on justice to recognise all the decisions of parallel courts and has taken the names of judges and prosecutors from Belgrade.
But Minister Tahiri said the oath of judges and prosecutors has been made according to procedures provided under Kosovo laws.
LDK MP Arben Gashi called the presentation of those documents by Hadziu and unacceptable if Kosovo has accepted such conditions. While Vetevendosje MP Sami Kurteshi said the basic principles of the Constitution are violated with this agreement.
Deputy Glauk Konjufca has also called this agreement unconstitutional, since under the document provided by the head, it appears there is an annex indicating that those appointments are made by politics and that judicial acts taken by parallel structures will be recognised by the judicial system.
Similar sentiments included Kosovo Deputy Initiative Bilall the Sheriff, under whom that agreement is not in the constitutional spirit and that Serbian President Aleksandar Vuciq's stamp appoints Serbian judges and prosecutors.
