Wessel has immunity, Selmanaj cannot sue him
The Constitution of the Republic of Kosovo, among other things, envisions MP immunity for their actions related to their scope, but also for actions that come beyond them.
The Parliament's “Deputies enjoy immunity from prosecution, civil indictments or dismissal for their actions and decisions within the scope of their responsibilities as parliament deputies. Immunity does not prevent prosecution of the Parliament's deputies for actions taken outside the scope of their responsibilities as deputies of the Parliament”, says Article 75 of the Constitution, where it speaks of MP immunity.
In the same under the Constitution is spoken further, saying the Parliament deputy cannot be arrested or banned while carrying out his duties as Parliament deputy, without the consent of the majority of all Parliament deputies.
About the issue of MPs' immunity had clarified even the Constitutional Court when it was ruling on the immunity of former Kosovo delegation Fatmir Limaj.

This has to do with prosecution for criminal acts which are supposed to have been committed before the start of their mandate and during the course of their term as deputies. MPs do not enjoy immunity from civil indictments for actions and decisions outside the scope of their responsibilities”, it said, among other things in that decision.
